Is it me or is it the system, I am tired of waiting

[/color][/font][/size]I was injured in May of 2006 , went to the company doctor who refered me to the E.R, senn that doctor and sent home. I then saw my neuro surgen why did CT Scan, due to I have a fused back no MRI could be taken. CT scan showed two bad Discs, I was then refered to a Pain Dr who did EMG, showed again two bad discs and loss of signal to my lower leg(s) , i then went through the injections, several of them, then a trial of the Spinal cord stimulator and then had it installed in my back. I went through two operations for this device, that don't due the job. In fact the unit hurts and the surgen who installed it says its better than nothing. This is the same guy who told me because of my injury and where its located in my back I may never get the proper relief that I should get. I asked several times why don't you just operate on the two bad discs and we could of got this over and done with. In the mean time, my so called attorney has kept coming up with excuse after excuse on why he can not get the deposition from the pain DR. Now after two years, 6 months and 21 days he finally gets the deposition. Now he tells me that there is one more he has to get from the DR who he sent me to for an independent say so.\
Is it me or the system, I can't wait any more, I am very upset at the who system that is in place for the injured. I have no income, the company caned me, the insurance company refeuses to pay my bills, I have never received any type of payment for my loss wages, the attorney is driving a BMW and my family gos without.
What can be done, I am told that the next slot the DR has is in December of 08 and then maybe then in Jan or Feb of 09 we might go to court. I know its to late in the ballgame to fire my attorney. Can I contact the Illinois work comp comission and tell them I want to go to court NOW.

You will surely be hearing the old "if we go to trial we risk getting nothing" speech from your attorney. The only way for the system to work is by making these attorneys go to trial and put their fees on the line, however I am convinced that there must be some type of backup compensation if they lose.

Harley, Welcome, I see you are also from Illinois as are several others including myself. The WC system is very slow here in Illinois. Are you saying WC is not paying your medical bills ?, and are you not getting any benifits from WC,? Have you been released (MMI) from your Dr to return to any employment?.

If not you do not want to settle untill all your medical needs have been met, Trying to get open medical here in Illinois at settlement is like pulling teeth. almost impossable.

Bad Boy Bad Boy is also from Illinois and hopefully will be on shortly with his opinion. He is most knowledgable with Il WC, and I as others do Value his opinion.
