I have a W/C claim in California. I was injured in 2000. The first claim has been settled. I get a monthly payment with full medical. But from my first initial injury other injuries occurred. My lawyer put in a claim for these other injuries. A few months ago I went to the W/C Dr. and another Dr. my lawyer had me go to. This Dr. put me P & S. W/C stopped my TD payments and is just paying me the money from my first settlement. My question is "if I am not released to go back to work shouldn't W/C be paying me something other than monies from my settlement?" I am asking this question because I can not get a response from my attorney.

being permanent and stationare (similar to MMI in other states) stops the recovery period benefits i.e. Temporary total disabillity.
within 14 days they should begin advancing permanent disability if there is any indication there will be some from the new injuries.

P.S. california doesn't pay on a monthly basis; your permanent disbility from the original injury should be paid every twop weeks. curious.

Thank you so much for the info 1171! Very helpful. I do get paid every 2 weeks but it is from my first settlement monies and have not received anything from the second claim which is due to go to hearing within the next 2 months. I have been reading through some of the other posts and W/C really needs to be looked into. This system is not right. I do know how a lot of people feel as I have been there. It is hard to survive on $230 a week even with SSDI. Thank you for being here for us who do not know and letting us vent.
