Question about Wyoming workers comp law

Hello, I joined this forum to get info for my son in law. I my self am from wisconsin, and here, when there is a work in jury, the bill HAS to be sent to workers comp insurance. My son in law lives and works in Wyoming, and has a ruptured disc, facing surgery next week, and his surgeon's office,has called and told them they were not aware this was a workers comp case. ( which they were) they told him that they want to bill under insurance, and after surgery he can send the bills to workers comp insurance. They informed him that if he insists on billing workers comp, then they will have to take him off of the surgery schedule, and wait at least a month to be put back on. He is in pain, needs this surgery, and agree'd so he won't loose his spot. Meanwhile, nothing is being billed to workers comp, has no checks comming in, doc has had him off of work for two weeks. I believe that this is wrong, and someone is railroading him somewhere.The doc's office said they had talked to workmans comp, and they have agree'd to this, in fact recommended it? Does'nt make sense to me. Does anyone have any info on Wyoming laws? Or Advice?

generally workers comp laws prohibit discrimination against the worker.
I would have him report the physcian's behavior to the state employment department.

Your son in law is getting shafted by his doctor. If his injuries are work related, and he has not filed an injury report with his employer, he should do so immediately. If he proceeds under private insurance it will make proving his injury claim all the more difficult in the future. I suspect the physician believes they will get paid more (or faster) through private insurance. Your son in law should not rely on what others tell him. He needs to take ownership in this and protect himself.
