Loss of benefits
Hello again,

I have a couple of questions. At one point during my injuy which was cervical and thoracic bulges and spondylosis, I started having problems with my lower back with sciatic pain of left buttock and leg.

I informed the w/c doc about this problem. He did a straight leg test, which was positive. He then ordered a MRI of the lumbar spine. He stated in the report, that he felt that my history of 3 falls, plus my symptoms could be a result of the previous injury. W/C at that time refused the MRI, however did authorize after W/C doc. put in for an appeal. After having the MRI done under my private insurance, W/C finally authorized the imaging.

Well here we are now almost two months later, with a letter from W/C stating that my ttd payments will stop, because I was to start back to work on modified duty. It states, that I have a nonindustrial medical reason for not returning to work.

I did not return to work per W/C orders because of the severe pain. However, my Primary doc. has me out until I am evaluated by an Orthopedic doc.

W/C has not, nor wanted to see my MRI results. They stated, " my lumbar and sciatic pain was not part of my original injury".

We all know that when one area breaksdown another compensates. So my question is this, should I speak to my attorney about trying to add this new issue to my claim?
