tangled case
I fell at work 11/2007 that resulted in a left arm deltoid nerve injury. I had nerve transplant surgery 04/2008. Prior to the fall I was being treated by an orthropedic doctor for arthritis. After two months of tests my orthro doctor finaly figured it out. when he made a report he stated that he believes that the injury is a result of the fall. The first hearing the lawyer for the insurance carrier told my lawyer that we did not have a case. they sent me for a IME their doctor said that in his opinion he cannot directly relate the injury to the fall but belives it was a pre-existing condition. I then asked my lawyer to get a report from my neurosurgen that performed the surgery. the neurosurgen stated that he believes the injury is a result of the fall and contested the IME doctors report. Now the insurance companys lawyer made a offer for settlement of one years compensation. My lawyer is asking for five. My nurosurgen stated in his report that it will be two years for a full recovery with 20 to 50 precent muscle loss. We go to mediation in november. They say if it does not get settled in mediation and goes to the judge for a decision I have a chance to loose. Any ideas or thoughts.
