Hi again,
Just had a notice from the surgeon to say that w/c are trying to ascertain whether or not this recent herniation is the result of a new traumatic incident and if surgery is required in order to have me return to work. I am guessing that this is pretty standard, but I thought, or at least my surgeon told me, that w/c own my injury at this site for life. If that is the case, why are they trying to see if I hurt myself all over again. I had surgery in Feb, and the pain returned in June, big time. They say that they want to review my files and make determinations on the claim. How can I hurt myself if I have still been going to physiotherapy? Can they actually say that this is a new injury?

In my state, the medical for my injury is for life. However; lets say that I go to work for another company and five years down the road, My back is injuried in the same place. Who is responsible??? The old IC or the new IC?????? Hopefully I never need find out, but I think it would go to the new IC.

Hopefully someone will be along to directly answere your question.
