What do you do in a case where you get hurt at work. The employer tells you to put it thru regular insurance and they will pay the co-pay? Now I left there because of problems and still haven't gotten paid for it.

why didnt it go through work comp???you can call the eeoc and talk to them but its your word against theres unless you have something in writting.others will be along soon with more advice.

Your Employer Basically Committed Insurance Fraud, and You Unknowingly went along with it, if Your State Requires that any Work Related Injury be Reported to the W/c System. If We had Your State We could Help You Better, if You don't want to give Us that, You May want to Search and Learn the w/c Rules You and Your Employer need to Follow, Sometimes as they Say "Ignorance is No Excuse for Breaking the Law"!! Is this a small buisness? That is BS. If you were hurt at work, you are to fill out a form the same day, and also have so many days afterwards to make the claim of wc injury. It should be posted in your worksite area somewhere. Contact the WC labor board for your state and let them investigate why it was not claimed and you had to use your own insurance. Did you go to the hospital and say it was a work injury? They should be paying the WHOLE bill and not just the co-pay. You could even contact your insurance co. and tell them that it was a work injury and they can go after their insurance co. for reimbursement.

Im in NY. It wasnt a big injury. Had to go to chiropractor for awhile. But was asked when things were going good there to put it thru regular insurance. Now that im not working there no more and have other problems where money owed to me wasn't paid, there giving me problems. And yes I know its going to be tuff to prove it. But I want to raise the issue so it doesn't happen again to someone else.

yes it was a work related injury with the owner in the room when it happened. Im only talking a bill under $100 that is owed but the principal that it happened and there trying to screw me on other stuff that is owed to me

Jazzy, You May want to Contact a Civil Attorney if it's only $100.00 Related to the Injury, and the other Items not being Related. You May get a Better Feel of Your Rights by going that Route, and I Hope it Works Out Well For You!!Wink

Always file a incident report on every work injury otherwise it may bite you in the ass later in life , meaning you never know if you'll develop a problem in the injured area. Be sure to keep a copy after you have your boss sign it.
