|
Need some advice
I need some advice guys regarding my finace. She has been having severe back pain for the past couple months. She never made an incident report due to it not being a set time it happened, more just over the time wokring there.
She went to the doctors 2 weeks ago and he got her an mri and said she had an bulging disk and put her on light duty. Dr. did say it was work related with her being a cna and most likly not from a one time thing but just lifting all the time. She relayed this back to her company who then told her she could not work there while on light duty since they beleive it was not work related. SO she has been using her pto time in order to get paid. We are contacting a lawyer either tonight or tomorrow night, but just wanted some advice. Does she have a case? |

yes . most state work comp systems allow cumlative trauma or repetitive motion injuries.

Ricky- Get a lawyer. Talk to more than one, do not sign anything until your girl friend decides who is going to do the best for her. Have your girl friend keep a log about her pain, what helps, what makes it worse, things it keeps her from doing, pain level. Reminder her as a CNA she know how to document and keep copy of everything. Keep copy of any reports, get copy of medical record and start a file. keep copy of all restictions, any time company says that they don't have light duty, get it in writing.

She needs to let her employer know that she needs to contact their WC for them to pay for her medical treatments. She also needs to file the injury report and get the paperwork going. She could be paid right now for being out of work if after so many days being off injured. The WC IC adjuster should be getting in touch with her to find out what happened so that it is documented and given a Claim #.
I do not know how it works in that state, but every trip she makes to the doctors, she needs to keep track of and write it down. She can be paid $0.058 cents a mile. Make sure she also checks into WC lawyers to just call and get some ideas of what she is entitled to. She should have no trouble with the claim for the type of injury she has, and the type of work she does. I hope she gets the help she needs.
