Good News for a change
I had my BRH (Benefit review hearing/TN WC) this past week. I have settled with my previous employer. Just a reminder I had 2 cases. One was a shoulder injury from 08/06 that required surgery in 11-07 and then PT. The 2nd was a wronfgul termination based on the fact I was terminated 2 days after I was injured. I had been employed almost 5 years and never had any corrective action or anything in my file but commendations-after I was injured I was terminated for failure to perform job duties. Anyway, the Labor Board Mediation came to the conclusion that I was terminated without good cause. I cannot name the amount or the company due to a confidentiality agreement but the wrongful term settled for about a half a year salary that I was being paid prior to termination.The shoulder injury rated at 9% settled at almost a years worth of salary. And I have open medical on the shoulder. So I am happy--I feel like a huge weight has been lifted. Now I am in the waiting game to see how long before they actually send it.

That is GOOD news!! I am happy for you, and yes, I do know what a GREAT RELIEF it is to have it over with. It really shouldnt take all that long to get your money. I think it took mine just over 2 weeks. Congratulations!! wishes for a pain-free day! annoyed |

What kind of working were you doing when you got hurt ??
Cervical Fusion 2003, c5-c6. Herniated and damaged Disc L1- L4-L5 S1. Lumbar Spinal Cord stimulator implant 09-2008. Cervical ACDF revision with hardware c4-c5-c6-c7 Sept 2009. SSDI approved 3-2010. NOW OFFICIALY RETIRED |

Good for you!! It is about time they make the companies pay for wrongful termination. You deserve it. When I got my hearing verdict, they were suppose to pay right away. I waited about 3 weeks and then called my adjuster to see where the check was. Good thing I did as he said he " Forgot" to send it out. It arrived at my house the next day.
If you see you do not have it in 2 -3 weeks, do not be afraid to call. They may even have 30 days to pay. What was your injury? I got paid 10% for my injury and that was not even a half year pay. carpal tunnel recurrence/ neuropathy / RSD. 1/29/07 injury date. Permanent. PIR settlement 8/4/08 10% |

I was a retail manager. And yes my Atty should get the check in 2 weeks. That is what the Labor Mediator directed. My Atty said he will hold it for 10 days and then send me my part. I had a torn rotator cup that did not get treatment for over a year, as I had to fight to get treatment. I had the shoulder cleaned out, the rotator cup repaired, the collar bone shaved, and 2 bone spurs removed.

Failed Back Surgery, Chronic Pain, Totally Disabled. Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!! |

I would like to ask you a question about your shoulder I to had a rotary cup repair, but I am still in a lot of pain, the surgery was done 4 months ago, i am not able to raise it half way and not able to sleep on that side or use the rest room to you know what, also when I spoken to my Dr. last he was saying something about a 65 percent inpairment, what does all that mean.

My shoulder was very sore, and I could not lift it. I have long hair and could not wash or brush it myself. It is now Sept and my surgery was in Dec and I still do my home exercises. I am still not able to bend it and scratch my own back. And I sleep with my arm propped up on a pillow because it hurts to let it drop. I am very careful with it and I do not lift anything even now. I just decided one day I wasn't going to do anything to risk hurting it, the whole healing hurt too bad. I wish you luck and as silly as it seems the little rubber band exercises at PT do work over time.

Deeenice and Mistreated- It has been almost five years on my shoulder and I still am not able to lift above my shoulder and I sleep with it on a pillow. Mine was a failure and will never be any better, I have a 5 lb weight restirction and that is perm. Continue your exercises and know it will slowly get a little better. The pain has never gone away due to RSD. AS far as impaiment rating, mine is at 85% as I am a nurse and will never be able to practice again as a ER nurse.
