comp. and health insurance
I am not sure if this is the right area to post this, but does anyone know if my employer has to continue to carry my health insurance on me if I was awarded pay for almost 10 years for carpal tunnel syndrome. I work for Ford motor company in Virginia, but they are closing our plant, but of course Ford still has to be pay me, since they are not going out of business all together. i have been notified through my local plant that my benefits and health insurance will be terminated in 30 days like every one else's. That would have been fine if I would have been expecting it, except my lawyer told me at first I would still get my health insurance for as long as i was being paid, and now he says something different. I figured I had it when I was injured, I would have it until my award was over. I guess this is another way they stick it to you when the working people get injured. Does anyone have any advice for me.

;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

Hi Julie and welcome. To my understanding all employers are different just as all state's are. The employer doesn't HAVE to do anything unless it's written in their handbook, a union contract, etc. as long as they treat all employees equally. No discrimination for being injured. y emploers policy is when a WC claim is accepted they do pay the health benefits until the case is settled, the employee reutrns to work. My claim was denied. Ihad enough sick time to carry me for 6 months. Through those 6 months the employer paid my benefits. I got a letter in the mail In the fall stating that I had used al of my paid leave and since I was now on unpaid leave I had to pay my own benefits ($1100 a month) in order to keep them. I have not been terminated at this point but could be at any moment. I feel thisis why your attorney changed his mind. He probably didn't anticipate your employer shutting down. I'm sure someone else will be along with more advise. That's just how my situation worked. CAP God is never late. In the end it doesn't matter how many years were in your life but how much life was in your years. |

If your insurance is not protected by union contract then you have to rely upon the federal FMLA protections which may have an exclusion for general layoffs and plant closings. you can check fmla laws on the dept of labor website.

Since you work for Named employer, have you been working these last 10 years? The employer you work for is self insured, and does pay their employers when off for work injuries. Also aren't you in the UAW Union? But even since they will continue to pay you, if the place of employment Termanates you, you Heatlh Insurance goes too. If the Plant is closing also. Being you work for said employer, surely you seen this before. They do pay you well also not to work. That much I do know. Reply's are intended solely for informational purposes. Hi,
My non union company policy stated they would offer you insurance until one hit MMI. I had to still pay my weekly insurance during this time ...but once I hit MMI.....poof! It was gone. Take care, Lilly
