workcomp lawyer ask for information form my past
Greetings all, I'm wt49 from Alabama, I have not posted any thing for a long time. I have just been seeing pain Dr. and going through the process. My lawyer filed suit agenst my workcomp a month ago. My question is concerning a form, or list of questions about me that my lawyer sent which he received form work comp lawyer. The request that botherd me are the following, 1. They are asking for my W-2's and tax forms for the last 10 years. 2. They are asking for a list of every thing I have ever went to a Dr. for in my life. (I just turned 59) 3. They want a copy of everything I have filed and sent to Social Security Disability. My question is this, has any of you faced this kind of harassment with your case. What does this have to do with my job where I was injured. The work comp laws deal with your present job and what you were making then. Not the past. I can understand if they wanted to know if I had ever filed a claim or been hurt on any other job in my past. I am upset, I have been pushed, harassed, treated like a crook, my integrity walked on. I have went to the Dr.s they said, did what they said. And now this??? Please let me know any personal ex. with this or anything about what the law says. Can I be made to give all this information?? Sorry to tell you this,but yes they can ask these questions, My daughter -in-law had to fill out 10 pages of like questions, I sat and helped her, some she had to call and ask her mother about. Like who was the Dr that delivered her when she was born, all of her medical and Drs that had treated her for anything including sore throats etc. she had to send the papers to her attorney and he in turn forwarded them to the IC. She is in Iowa........
Her attorney said do not go into detail, just stick to facts and dates as close as you can and if you don't remember or can not answer just say so and move on to the next question. Good luck PS, Before sending papers, make sure you have a copy for your records. Life isn't about waiting for the storm to pass. It's about learning to dance in the rain. |

I heard of this in some States. From what I remember, those question should be answered to the best of you knowledge only. If you don't know something say so. Did you ask your Attorney about this, and what did they say.

I was never asked any of them questions here in NH throughout my whole case. The only time I was questioned anything about the past, is at my hearing from the IC lawyer about my carpal surgery I had 10 yrs. ago. I told him the truth about everything of my past surgery and how it was never a WC suit at the time of injury before my surgery. It was around the time I first started using computers and did not blame it on my job.

I have been in the Same Situation, with the i/c wanting Info. after Info. and asking Me to Supply it, and My Attorney made it Very Clear that We are not going to do Their Work for them! We give Very Basic Info., and if they want any Dr. Reports, I Sign a Release Form for them, and they Pay to have the Files Compiled and Sent! They have Assistants, and Quite Frankly, I am not going to do ANY Work for them, they are trying to Take My Benefits Away!! Why would I want to Help Them do that? Please Speak to Your Attorney before You Send anything, You May even want to have them Proof Read by Your Attorney before Sending if You do Fill Out the Forms. My Best to You,and Have a Great Day!!
Failed Back Surgery, Chronic Pain, Totally Disabled. Knowledge is Power, Especially in the World of w/c. Learn as Much as You can about Your States w/c Laws, and don't Fight Battles alone, They Use Attorney's, and so Should You!! |
