Any and all advice would be appreciated.....this happed 9/2........I have been off work.....I gave a deposition to the underwriter(I don't know if I should have spoken to a lawyer first)........I have had an MRI of my foot, ankle and knee....this is a re occurring injury the first time I did not seek an attorney.....I just want advice...these days we all need our jobs.....but I dont want to be stupid about this either....if this injury will affect my life....I have a follow up with my MRI early this week.......HELP PLEASE.......a settlement would not cover me with insurance the rest of my life I'm sure....my husband believe it might....he lives in the dark ages our parent grew up in....employers dont care about employees......I live in the Chicago area........any, any, help at all would be most appreciated........I am wet behind the ears.....and I cant trust the school the work for........thank you in advance ladies and gentlemen.

need a whole lot more info what happened ...were you a volunteer or on the clock ..what state...just what are the injuries....come on give us more info to work with

The MRI will tell the tale, And no you are right, Settlement will not support you for a lifetime... Do not even think of settlement untill your injury is as good as it is going to get or as back to normal as it can be. ( MMI) If you are receiving treatment for your injury and WC is paying the medical bills, there is no need for an attorney yet.

What do you mean you gave a deposition to the underwriter?. Do you mean you filled out an injury report? Do not sign anything yet. We do need more info about your injury and treatment, There are a few of us from Illinois that can help answer your questions, But as I have said we need more information. Welcome.

reg employee,in union, state of Illinois....ankle,foot and knee...MRI results later this week....

Recorded statement to underwriter.....reports filled with supervisor and school nurse.....I was left waiting and hour and a half til I was driven by my supervisor to the workman's comp clinic.....after I was in too much pain to drive myself....I was told no ambulance by my supervisor the principal wants to save money (nice huh)...waiting on MRI results on foot, ankle and knee, arm chair swung back and hit my knee and broke skin as well right through my pants (heavy jeans)...glad you are in Illinois as well....all help is appreciated....many thanks....I have signed nothing but school reports and treatment and MRI orders for now.....

So this is a recurring injury? Did you ever settle before with the IC the origional injury was from? Seems like alot of info missing and what exactly is the question? Welcome to the forum.

Is there a WC lawyer that you have had in the past for the recurring injury? If it is recurring, you know that there will be a bicker and back of who wants to pay for the treatments. The new employer or the one before. Good luck.

I am not familiar with unions here in Illinois, Maybe Bad Boy Bad Boy will come on and give you his opinion, He is also from Illinois and in your area, Hang in there and if we can help in any other way feel free to ask. are you off work at this time? Start saving all info on your injury, and make sure you have copys of everything.
Being Iam (was) in nursing, I know what it is to have a foot run over by a wheel chair. It hurts, so a electric chair must really hurt as they weigh much more. Lets hope the Mri shows little damage. There is not much you can do untill the results of the MRI are in. Take care and keep us posted.

At this early of the stage, I say, what for the results of the MRI. For no one can or will do anything till they know what is wrong with you. Even a Attorney can't do much, even at this early stage.

Union, what would you like to do with the Union as far as this goes? Which Union are you in? Do you have the Union hand book? If so, go to the index, find Workmen's Compensation, and go to that page.

Personally I do not think I would of ever needed to get a lawyer involved in my case the whole time till it came down to my PIR rating. As most know on here, I never did hire a lawyer. I kicked myself in the butt for not getting one in the middle of my case when I had that problem with the IC sending me for a IME to dispute my rating from 32% to 10%. I feel If I had a lawyer go to court with me that I would of still had my medication paid for, and my rating might of gone from the 10% I won to maybe 15%. Personally I found 32% without surgery very high myself. I accepted the 10% and my health insurance pays for my medication now. I still get medical treatment paid for from WC and my mileage of 250 miles round trip monthly for my pain management appointments.

I think at some point in every case, the IC will dispute something and that is when you feel you need a lawyer. If you are not getting your treatments paid for, your rating low, your payments for being out of work etc. I chose to go Pro-se and do not really regret it as long as my medical is paid for and I can still get my treatments from my WORK injury. I have health insurance and my settlement is still sitting in the bank for a rainy day.
