Score one for the little guy
After my injury last year I tried to return to work. However the company fired me when I could no longer perform the job that I had worked in for two years. In January they told me I needed to start looking for a job and required me to fill out forms and turn them in to prove that I had been actively searching for a job.

Well I have been doing that since Jan and have gone back and forth with them. Them claiming that they lost the forms or accusing me of not sending the forms at all.

Anyway, last month around the 15th I filed a complaint with the state. It went to a judge and the judge contacted the insurance company who promptly told the judge in writing that I had failed to file the paperwork needed. The judge sent a copy of the report to me and gave me 10 days to respond.

In turn I sent the judge every scrap of paperwork from Jan through the end of June including emails. Turns out the judge wasn't happy with the insurance company and ordered them to cut me a check the day she got my package.

Well I got the check today, the wife took it down and deposited it and the bank put a hold on it until the 10th of next month! Just my luck, even when I win, I still lose.

Congrats to you!!! And also a reminder to all of us of the importance of keeping copies of EVERYTHING just in case it's needed down the road. Congrats again.

congrats nows its in the judges mind they are trying to stiff you....keep doing right and you will be ok.....talk to your banker if you have had an account there for awhile ask him to call you when it clears let him know its gro and light bill money....most checks clear in less than 5 days...with computers and such now

;)Workmans comp is not a road you want to travel alone. You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life, you have come out ahead of the game.....Smile

Sadly no we dont anymore. When I got injured we had a good amount in savings, but that was all eaten up covering bills after I got injured. Now I am way behind on everything and don't really see a way to catch up.

RE: Score one for the little guy

Jerry....my husband was injured in '03 and i was in '06. He made alot more than I did. We had about 6 months bills put aside for a rainy day. I was working FT , took all the overtime I could get. The first thing we did was took out a small Home Equity line of credit and paid both of our cars off and every unnecessary bill we had. It dropped our payments from $900 a month to $100. Then we started cutting everything else we could. Finally when we were at our wits end my husband told his attorney we really needed help. He borrowed $$$ from a co. that gives loans on a prospective settlement. If my husband lost his case we would have owed nothing. He won, settled six months later. All loans were paid off, repairs done to our home, and some was left to put away. I was injured exactly 2 months after he won. Took me 14 months to win my case. We have been very, very fortunate through the $$$$ end of WC in that we never lost anything. There is help out there for utility bills, food, medical, etc. We thank God everyday that we put a part of my husband's settlement away. I have not settled my case yet, he only collects SSD which is nominal> He was dx with cancer in Feb and we are pulling from what we have weekly for co-pays for Dr.s and meds. So you see God has a plan. We don't always know what it is or why but He does. Best of luck and prayers to you.
