Question on eligiblity?
My brother injured his back on the job back in February but he never filed for Workman's Comp. He had to quit his job because the pain was too much for him to do the lifting he was required to do. Is he still eligible for workman's comp? He hasn't been able to find a job since then.

RE: Question on eligiblity?
If he never filed a claim, or reported the injury. He will have a very hard time making a claim now this many months later.

RE: Question on eligiblity?
Each state has it's own rules about how long a worker has to report an injury to the employer or carrier.
the state work comp legal system also has time limits as to how long a worker has to appeal to the comp board or commission.
As bad boy says it's more difficult to get a former employer to pick up an old claim but technically he probably can still file for it.
