my lawyer sent me a draft of the settlement last week and told me to look over it and if i agree with everything to let him know so he can get the final copy. i had to sign some kind of medicaid form and i sent it in friday so he should get it no later than tomorrow. i have two questions. 1. how much time am i looking at from getting the final copy to cashing my check. 2. i know my lawyer can't give me a loan but is it possible for me to take my settlement draft to a bank or loan company and get money from that since its for sure money i got coming.

What do you mean Medicaid form,???? Medicaid is a state administerd program, for low income or disabled people. Have you been found disabled? and if so and you receive a settlement the state can place a lien on any settlement you receive to recoup any benifits they have payed through Medicaid. Are you sure that is what your papers were?. or were they medicare?????? Medicare and Medicaid are 2 different and seperate programs.
I would not plan on cashing that check anytime soon, at least untill you have it in your hands. which could be a while coming, Sorry to say but you may not have any choice but to wait it out. It took me 6 months from the time I signed my settlement papers. And before I could sign the final papers it took a year to receive a letter from Medicare stating I owed them nothing. I am in Illinois. Life isn't about waiting for the storm to pass. It's about learning to dance in the rain. |

A draft is just that, a draft until signed by both parties and oked by a judge it is worthless
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

Ok, I'm probably going to tick some people off but I'm going to say this anyway.... palmtreesandparakeets, I don't trust you. I believe that people like you are why people like us have so much difficulty in the WC system. Your very first post on this thread states "he also brought up an issue that i thought was dead" and "of course i act like i didn't know what he was talking about". Sounds to me like you're being very deceptive....and I for one am paying the price because I am being treated like I am lying. My injuries are what they are...no more, no less. I am a firm believer in the telling the truth...that way you don't have to remember what you told to who. Further in this thread (post 8) you stated that "you forgot all about that" yet you list alot of details about the prior injury for "forgetting" all about that....seems like you forgot what you told us in your first post. If I'm wrong, I apologize...but I don't think I am.

you are not alone snowbear I thought I made that clear.....he has been about money from post one not getting well..many on here in worse shape and having had surgery and still fighting just to get well and he gets a big offer outa the gate and no surgery.....I smell a rat...

Good Point Snowbear and Jayne, that's Why if You look back, I Stated I would not Reply to anymore of these Threads from this Person, when You give them Sound Advice, they skip over it and look for the Easy Money Way Out! It's a Shame that Folks do this, but I Guess it will always be this Way!!

And I am one of the injured workers that the doctor and wc didn't believe was really injured until the doctor did surgery.
After surgery the doctor apologized to my family and said, "She wasn't lying she really was injured, I didn't realize how bad it was". I spent over two years in court fighting to get the medical treatment I needed. The few "injured" workers that lie and makeup stories makes it difficult for those of us that are truly injured. |

I did not want to be rude but noticed the BS since Palm first came on here. Nothing has added up , and different stories all the time. Hopefully he gets what he deserves and it will all catch up with him eventually. He is in for a rude awakening when he finds out he will not walk away with much if anything at all.
All I have ever asked for since I have been on WC is treatment. Money was the least of my thoughts. I just received a award and it is still sitting in the bank for a rainy day. I only wish I could get this arm fixed. To be pain free is what I pray for each day, not $$. If I were you Palm, I would be looking for a job you could do with your injuries. Something within your restrictions if you need money that fast to have to borrow. Plus I would not borrow as you have no idea if you will receive anything at all to pay it back. Your only going to get yourself deeper into debt. carpal tunnel recurrence/ neuropathy / RSD. 1/29/07 injury date. Permanent. PIR settlement 8/4/08 10% |
