i just hung up with my lawyer and he said they claim they got medical records saying i fell from a height. i don't know what they talking about. anyway my lawyer said that we got a good offer and the process takes up too two months. whats so hard about typing papers having the judge sign them and cut the check. why does that take 60 days. am i missing something. is there anybody else besides child support that can cut into your settlement???????

I agree with all that Jayne and BB have saidSmile and will still hold true that if you lie under oath , I don't care how big or small it seems, some hot shot in the attorney general's office can pick up on it years later. Also IF your settlment happens to be one of the ones audited in the insurance co. someone can pick up a discrepancy then also. This friend of mine was prosecuted and made an example of because of all the insurance fraud going on.It is also in his papers that their was a prior injury from an auto accident. Case still settled. Attorney knew and so did the IC. Attorney said don't worry about it and then refused to testify on his behalf in the perjury trial.I'm not saying your case is the same just giving you someone else's turn on it.

My personal opinion is, if you tell the truth, you should have no problem . Past or present. I still do not see how they are going to pay you 50,000 that easily. They fought me to pay me 7,500.00 and stop payments on my meds. They did not dispute your rating?

carpal tunnel recurrence/ neuropathy / RSD.

i talked to my lawyer today and he said that he had a draft of the section 32 settlement and he had to go over it with me and have me sign it and then we would get the final copy. i assume this means the ball is rolling. he said it might take a couple of months but he would try to get it done a.s.a.p. i hope two months is just what he tells people and its really more like two weeks or two days.lol

When I settled, I first signed the papers, Then they had to be ok,ed by the arbutrator which took a week, Then I had to wait for the IC to cut the check, they had 8 weeks to respond and get the check to my attorney. The check was hand delivered the day before the 8 weeks were up They just waited untill the last day, so don't be surprised......I am in Illinois.

It sounds like your attorney is looking at a Medicare set aside, I did not have that as It is usually for future medical treatment, and I was already receiving my retirement SS. When you go to sign your papers your attorney should explain all this to you. Do not sign anything untill you understand and have all the facts.

Unless you used medicaid ( federal assistance ) for some of your medical for your injury, They may have placed a lean against your settlement, which will have to be payed back.

I hope I am making sence, or maybe others can come on and add there opinions.....

Insurance companies will normally take the complete time available by law to cut your check. Part of an IC's profit comes from investing the money they collect in premiums. The longer they can hang on to that money, the more they can make on it in investments. The same holds true for any med or TTD payments they make. I am not saying they will intentionally be late, but they will take the full time allowed. There is no financial incentive for getting you your money early.
