Julian.....I am going to try to be blunt without being offensive. First off your attorney is not suing for anything. WC pays lost wages. There is no "suing" for anything incuding pain and suffering. That being said I will second what Jayne has said. Sometimes there is never an "offer" made so to give you a time limit is impossible. In mine and my husband's case when the Judge decided in our behalf, won if you would like to use that term, first thing that was paid was our back wages. We were both paid back to date of injury less 20% (which is the limit in our state) to our attorney. My husband was made an offer 3 months later and settled a total of 5 months after winning. In my case I have been paid since 14 months after being injured and the Judge deciding in my behalf. That was a year ago. I have not been made an offer yet. There is so much to consider with a WC claim and without a state, injuries , treatment, etc or more info I don't know what else to tell you. Your best bet is to concentrate on getting well, going back to work if at all possible and listening to your Dr. Money is always something we think of as some of us go hungry BUT in the WC system with an injured body it shouldn't/can't be the sole concern. I hope I helped.

My injury are permanent and i was under a dr care for over a year i live in california my case coordinator says i will receive money i dont know

RE: back injury
What are your injurys? did you have surgery?. are you back to work?. are you receiving WC benifits?. These are the questions we need answered.............. and if you have an attorney you should be asking him questions. Good luck as Wc is not a fun road to travel. How do you know that your injurys are permanent?. are you still receiving medical treatment?

RE: back injury
MMI =maximum medical improvement....in other words you are as fixed as you can get....there is nothing else the docs can do to make you get better...
now we really need to know your state....and your injury such as for me I live and was hurt in Okla...my injuries were to my cervical and lumbar....fusion done on cervical discs it failed...we cant answer anything without state and your injuries

RE: back injury
If you are released to return to work by your treating DR....you must return. If your employment has no light duty work for you, they do not have to let you come back. That's where voc rehab comes in (not sure about Calif though). Voc rehab would test you to see what your skills and weak points are, and try to help you find a job from there. If they find you a job, most likely there will be no settlement in the end....but if your case worker says there'll be one...then he-ha! Length of time depends on how back logged things are, and can vary greatly. Me, i was offered settlement last summer...and things have been in a stand still ever since. I was injured in 2004. Hopefully 1171 will be along shortly to give you an informed answer.
Take care, & Good Luck, LillySmile

Injured worker, & tired of it all! I'm too old for games!!
