As the others have said, depends on if it is an accepted claim. Also, in Texas employers may choose not to carry WC however all that aside, here is some information.

Texas statutes regarding Death Benefits: http://www.workerscompensation.com/regul...Parent=238

Death benefits are paid if there is a surviving spouse; dependent child; dependent grandchild; or other eligible dependent family member.

Except for the spouse and minor children, other family members must have been at least 20 percent dependent on the deceased worker's income to receive death benefits.

Funeral expenses up to $6,000.00 paid to the person who paid the deceased worker's funeral expenses. (401.186)

So sorry for your loss.

This may not be the time to ask but I would be interested in knowing what happens to the driver of the front loader. I am sure he had to be certified to drive for the company (I would think like a fork lift driver has to be certified ). Or was he the owner of the front loader. there was definately some safety issues involved here. So sorry for the loss of such a young man. The others that were injured is the company covering there medical for them?

my prayers are going up for this young man and his family....I also would like to hear what happened to the driver...such a horriable accident

;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....Smile
