RE: ssd
If I understand it right when you go on ssdi, you are allowed to draw 80% of your wages, the amount they come up with is figured by the last 5 years wages and averaged out.So if you are still drawing certain pay, then they will offset that amount,I think the backpay goes back to when they determine the time that you were considered disabled,so it all depends, if I am wrong on any of this , please someone correct me,I also do believe they will offset your backpay too.Halftrak

hurt...You are also in my prayers, as I know you are in terrible pain.
I hope you are awarded SSD, so you can get on with your life.

I dont think it is 80 percent of your wages. It goes by how much you have paid in. I have worked my whole adult life and I will be getting 1,300 a month. That is less than half of what I was making.

RE: ssd
Total of WC AND SSD combined, can't exceed 80% (this is why they 'Off set' your SSD amount)... I believe it is 80% of your take home pay....i may be incorrect. it also has to do with the amount you have paid in as pavillion says.
Confusing, none the less.

;)Workmans comp is not a road you want to travel alone. You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life, you have come out ahead of the game.....Smile

RE: ssd
If you go to the ssa website it will probably explain any questions that you might have, also if you have your ss statements that you have gotten every year that has your annual income then you can do a estimate and at least get a ballpark figure on what you can get every month.Hope this helps you out, I figured out mine that way and was only off by about 50 dollars.Halftrak

RE: ssd
My SSDI payments were based on my past prior 5 years of income. They took the highest year of the 5 years, and that was how they based my SSDI payments.

I also get my Union early retirement disability. Between the 2 checks, I am now making more than if I were working.

But I must say, till it all came together, money was very tight.

You can go to the SS web site and see allowable income one can make per year also.

Plus the IC still owes me $320.. per week for 3 years, that they didn't pay me yet in TTD checks. I want that before I settle my case.

RE: ssd
it does shed so light i was making alot well it was alot to me 75-80,000 a year for the last 5 i worked.but in a steel mill they pay you to be there and the more you make them the more i made and thats not counting stock options twice a year.i have been working since 1984 and paid my ssd and taxes.so it should not be to bad and comps not through yet so thanks all guess i will have to wait and see what happens.
