injured after coming back from surgery
I had surgery ( a hystertomy ) on may 2 , i came back to work after 9 weeks off .On my third day back i was lifting a heavy tun to empty the parts in another tub and pulled something in my lower right belly around where they did my surgery . I went to my doctor because of the personal area to be checked and she put me took me out the rest of the week was just fri sat and sun . well they sed i had to go to their doctor to the same day and theirs just poked my belly twice and said u have to go back to werk fri . I'm wantin to know if they can over ride your doctor's note and make you go back to work . Even tho theirs put me on light duty it took 4 hours before they seen to the light duty work an i was left pickin up heavy tubs in that 4 hours and hurtin worse that mornin then i had two days before .

Do I understand that you had restrictions and you worked 4 hrs against them before they realized? You have to keep a copy of your restricions with you, and communicate to whomever is dictating the work out. If you were not able to do what they asked you have to let them know it is against your restricitions.

((The surgeon will arrange a post-operative appointment to ensure healing is going well. This is usually about six weeks after the surgery.))
Surgery was non work related. Then you did your Post Op visit with your doctor to check that your healing well. This does not mean your fully healed. You return to work on week 9 Post Op. Then 3rd. day of being back at work, you were lifting heavy tubs. Surely I would think you caused pain to your surgery area. But is this work related, being returned to work, while still in the healing process of a surgery not related to a work injury? I don't have that answer. treatment rules depend on your state's work comp laws but generally the employer controls the treatment on their insurance and their claim.

Yes they knew about my restrition because it was their doctor that gave them to me but they acted like they didnt even know that theirs doctor over ruled my doctors note on comin back the next day .and yea it was injured in the site where i had the surgery , still in the healin prosses . The company i work for has no feelins for their employees and my team leader and upper managament has even less feelings . Thats why i was wonderin if they could over rule my doctor that had done the surgery and i seen the same day . i also had to go to the ER friday nite because the pain is not gettin better it seems to increase and he thinks its more then a pulled muscule an only real way to tell is go back in an take a look so i am clueless about the Ga. wc laws and in pain sittin an standin and is due back to work on monday . Any help would be aprecated in my situation

Did they send you to a oby/gyn? To check for related injury to surgery site? If not, sure their doctor is in control of their work comp claims. Unless your doctor is listed as one of their work comp doctor's.
Question is this; When you first went back to work on that 9th week Post Op, did your Doctor put restrictions on you? Now this would be where the restrictions should of came from, from the get go. Not just once you hurt your surgery area. Why didn't your doctor place work restrictions on you before returning to work so you wouldn't hurt yourself. Now as you can see, their going to toss the ball back and forth, and they will end up blaming you or your doctor. Reply's are intended solely for informational purposes. They said i can go on to my doctor because of where the injury had happened an something else happened at the time i pulled somethang and it left them and me embarrassed at talkin about it so they gave me the ok to go to my doctor . Then later that day HR called an said i had to see the WC doctor so i went up there . All she did was poke my belly twice and gave me a ice pack a warm pack and soem ibephoen . She didnt even really take a look . I think her mind was made up before i got there and the first thing out of her mouth when she walked in the room was that " they are there to get me to work tomorrow " |

Again I ask?
You seen your Doctor, before you returned to work on week 9 Post-Op, and you seen your Doctor again after said hurt yourself, at anytime did your treating Doctor place any Restrictions on you for work???? Or was it the company Doctor that placed restrition on you? If only the Company Doctor, then what in the heck was your Doctor thinking then?
