wondering??????
if i've gotten my rating and i've been put at mmi do i have to wait until i go to court before ic starts paying me again. they stopped because of ime report in january. my last court date my lawyer asked the judge for back pay and he said he wanted testimony from all treating doctors. all have testified except for my main doctor he testifying in person on my court date 7/18. all have said injury and i'm pretty sure he gonna say injury too.lol. my question is how does the process work. is the judge gonna hear his testimony and make a decision that day or later on and if later how long. if he does that day can the ic argue his decision. i figure once medical evidence is in and even their ime doctor is now saying injury what's the argument about. one last thing i hadn't had my rating or put at mmi when they scheduled my 7/18 court date will that be addressed then or will this be put off again.

decisions are appealed rather then argued.
the other party is allowed to object to the rating. it'll be put off if they object. |

1171 thats another thing that i was concerned about i see everyone on here saying they got a rating and their rating was a specific number. New York doesn't work like that. they have 25-50-75-100. after i took my fce last week my doctor gave me a rating of mild/moderate which he says is between 25-50. i know that my lawyer gonna want 50. my question i know the ic can argue the 50 but can they try to go lower than the 25. also once thats determine how do i figure what all i'm entitled too. i know medical but someone was telling me that i would get wage deduction and a check based on my rating. i know if i was working my wc wage would be 2/3 difference up to 400. i'm not working so what would they go by???
