Need some advice please
Im needing a bit of advise, I, like yall was injured at work, but I didnt know it till the next day. So i went to my doc paid my deductible and when they asked is it work related i said no. Reason being is i thougt the problem was minor and just needed some meds from doctor. I took a week off "worked from home" and returned to work but still hurting quite badly. I have since been to Back Specialist got an MRI and shows that i have 2 herniated disk. Not so Minor any more.
By the way I am an employee of a familly owned bussines and my parent is one of the owners.
Keeping that in mind, I has been nearly 6 weeks since this started and im not sure how to handle this, 3 days ago i mentioned to one of the officers of the company that at this point i need to file Workmans Comp, Reply was "I understand we wont fight it".

What steps should i approach this with, i doubt any report has been filed by employer and this being probly the first claim they dont know what to do either. Im still working "Desk Jocky" using meds to relieve the pain.

What should I do, Do i need to call the doctors and tell them oops ya it did happen at work? im sure they have used my normal insurance by now. at the same time i want to handle this delicataly due to being child of owner.

workers comp insurance in texas is voluntary. If there is coverage the rules are state enforced by the Texas dept of Insurance including filing forms and time limits etc.
if no coverage then it's pretty much up to employer and other insurance as to how it's handled.

why dont you just ask to have it turned in to wc as it happened at work correct?if its family or not it happened at work.you are entitled to wc benifits as well as anyone else.i see what ur saying but if ur insurance company finds out if happened at work they can make you pay them back for any money they pay out and they can.talk to ur family about the problem be up front things happen it not like you asked to get hurt im sure they will understand.man thing happen just be honest thats the best thing you can do.and good luck.

unless the employer opts to provide comp insurance there is no work comp coverage and injured worker is NOT entitled to work comp benefits.

1171 is correct. wc coverage in texas is not madatory. I would check and see if the company has wc coverage. If not, the way I see things unfolding would be that of civil court.

There is wc coverage, I have downloaded the employers paperwork yester day and will deliver them to the the boss this evening "after work". so my weekend will be semi stress free. Today im going for my first of 20 treatments of Decompression. Any of you have that done? what do think help or just another way to get into my pocket for money?

Texan, You seem to be Handling things Very Well, and You should Apply for Your w/c as soon as Possible. Be Upfront and Honest, as it seems You are already doing, and Hopefully all will go Well!Wink

As far as Decompression, in My Opinion with 2 Herniated Discs, depending on the Severity of the Intrusion Out of the Disc Layer Space (How far out the Pulpus, or Center of the Disc has left the Outer Layers) You may only feel a bit of Relief, with the Pain returning. From what I have Read it can be Beneficial with Bulges, but if Your Herniation is causing Severe Pain and Nerve Impingement, Surgery May be Necessary. Try a Few Sessions, but be Sure they know this is a Work Related Injury, so when Your w/c Papers are Filed, they will be Paid from the Correct Ins. Co. Best of Luck, and I Hope All Goes Well!!Wink

i tried decompression it didnt help me it made me hurt more,but it might help you.just make sure if it starts hurting to tell them so things dont get worse or they hurt you more than you are.i sure hope it helps back pain is no fun or any pain for that matter.i sure hope you dont end up needing back surgery good luck my friend.
