Disputing impairment rating, Texas.
My treating doctor sent me to a doctor to get an impairment rating, he gave me a total body 19 percent. Workers comp sent me to another doctor who gave me a 0 percent. They both used the same manuel, and are both certified to do the impairment ratings, go figure. When my treating doctor called me in to discuss the second doctors rating, he said his office would dispute the 0 percent. I have since read that I have to dispute it myself in writing. Is this true? What do I need to do? I am very upset. I have a lot of pain from my injuries still. The mri showed tearing in the muscles and tendinitis with accumulating fluid. My doctor said there is nothing that can be done about this. When I went to the second dr. my ankle was swollen at the time, and he still gave me a 0 percent. In his notes, he said that I was able to sit comfortably while discussing the problem and lift my leg on the table to point out where I was having problems. This is true, he made no mention of the fact that I told him that the pain was directly in proportion to my activity level, and that driving, or standing and walking for periods of time aggrivated it, causing pain and swelling. Can anyone explain the process for dispute, and what I might expect. One thing I never expected was a 0 percent.
