Speaking from Pa. Rules, and in My Situation, I am being Paid TTD from the Ins. Co. My Employer Retained to handle their w/c liabilities. Any Settlement I receive in the Future will not include any TTD Paid to Date, when they Settle they are Settling the Future of Your Case, not the Amounts already Paid. If another Ins. Co. other than this Type is Involved, they May seek Relief for the Monies already Paid, but if it's the Employers Ins. Co. Retained to handle their Claims, no TTD should be Re payed!Wink

Failed Back Surgery, Chronic Pain, Totally Disabled.

all i know is the lady told me if i win wc or ssd they will take back some of they money they have paid me my lawyer said the same thing that they will want some money back.but i dont know how much that is.thx all.

I don't know for sure about Indiana, but whenever I had cases similar to this, if the IW won and the Judge said that WC should pay, we (the WC Insurance company) paid the other company directly. It was never included in the settlement to begin with. It was totally separate and had nothing to do with the IW's settlement.

Basically what it boiled down to was, if the IW won, it meant WC should have been paying the wages and/or medical all along, not the other company so WC had to repay them.

Like I said, I'm not familiar with Indiana rules so do talk to your attorney and have him/her explain how it works.

thx kate this is just so confusing i thought i was going to take the hit for the money.the way ic talks they can also take the money out of ssd if i win that first and there lawyers are the ones handling the ssd.i dont know if thats good or bad them handling the ssd but i guess i will find out.all i can do is hope things get going again soon,in indiana the wc judge gets the summer of like a school kid LOL.thx again this makes more sense guess im alittle slow.if i win wc will be in deep with my priv ins,me and ttd ins theres alot of money that has been spent by all of use.

If I'm interpreting this correctly I would think nothing more than what was paid out could be paid back. If WC pays you back to the DOI then you would be being paid twice for the same time span and I would think this is what the other company would want back. Not sure if I'm understanding this right but that's my opinion.
