Question mediation not long ago
hello all its been awhile.heres the deal had my mediation over 30 day ago in the settlement papers the other side was to pay me and my lawyer with in 20 days.well its been over 30 days the papers are legal and binding.these papers stated that if either side did not perform that it could be introduced into litigation failer to perform.the checks were to be sent to me and my lawyer.he would get his in the mail and the same for me.should i call him?i dont wont to look money hungry or seem pushy.but the other side were butts the whole time,i was nice and polite as well as my lawyer.they wanted this over with so why breach the contract?they could end up in court and lose this is all legal and signed by both side stating we all understand our duties to perform.any good advice?im going to call my lawyer monday if the checks not here today.

man i thought wc was bad,the mail came and no checks what a suprise.thought i would give them the benifit of the dought guess they dont want to live up to there own terms in the agreement.i wonder what a judge would say or do?just pay that they owe or make it more?just wondering.have a good week end all.

call your lawyer....my check went to my lawyer......fines are pretty steep if they dont comply......and its usually work days not calendar days...but call your lawyer so he knows he may have got his and need to know you didnt get yours

thanks jayne.the legal papers state that they were to come to me not my lawyer and his to him directly.but i am going to check monday to see.feels like comp all over again hurry up and wait.i see your dancing again and admin let you out lol you must have good and playing nice.lol

My settlement check also went to my Attorney first, He than took his cut and issued me a check from his account. It took me almost 8 weeks and the day before the 8 weeks were up the check was hand delivered to my attorney........ They play games right up to the last minute. I am in Illinois

hi tuffy the legal papers state that they would cut him his own check and cut me my checks and come rite to me not my lawyer.thats why im wondering why there still playing around seeings how there in breach of contract.

Is there a monetary fine if they don't pay you within the 20 days? If so, HEE HA, it could be worth the wait....and no, you don't sound money hungry.....you just want what's owed to you, and I would too!
Call your lawyer...your ck could be laying in his unopened mail pile, even though IC stated they'd send it to you... You & I both know, that IC doesn't do what they say they are gonna do. Even when court ordered!

this is money thats coming from exemployer i suid.im still working on wc STILL.herein indiana the judge gets to take 3 mnths off over the summer.so it will be awhile before anything gets going again on the wc.thats why the other side cancelled the last hearing they knew that.if i win wc they will wow me and alot of other people a butt load of money.the last count my lawyer seen in bills was well over 200,000 in med bills alone not counting my meds,driving and so on.thank have a good week end nice to hear from you.wish you well.hurt and looooosssssing my mind lol.

Hurt, if I read this Correctly, the Money is not coming from w/c, but either from Your Employer or their Liability Ins. Co. Correct? If that's the Case, it seems to Me that You would have to go to Civil Court to have them Pay. Please let Me know if I'm Reading this Correct, and Have a Great Day!!Wink
