court question
Hello again everyone,
I'm so lost feeling at this point I could realy use some help.
I still havent even been to court to get w/c checks, I'm up to 30 thousand in owed back pay as it is. Does it always take forever to even get a court date ? I have had one failed surgery, many diagnosis, and deteriating by the day. Today I spent the day in the hospital becouse I woke up with little controll over my arm ahhh.
I was told that I would not be able to do the job I was doing or anything close ever again But there is no way I will ever find another job makeing 19 dollars an hour with just a GED. Will w/c have to make up the difference ? I can feel the depresion in me growing but I try real hard like others have said to look at the bright side. I read all the posts and se some of you have been going through this for years, You are all so strong I only hope I can be as strong years from now.

RE: court question
I am so sorry for what you are going through. I know that this system can truly drive a person nuts, huh? In VA, it takes about 9 months to get a court date. How long has it been for you? For them to owe you 30,000+...it must be a lot longer than a year, I'd guess. Do you have a lawyer? Why are they not paying...are they saying that they don't agree that you were injured at work? If you don't have a lawyer, it seems like this would be a good time to get one.

In VA, the i/c has to pay you the difference between you old job and any new job that you can get.

Continue to come and post here. We all understand the frustrations that come with being in this position.

RE: court question
It's been 10 months for me so far but I worked a 12 hour rotation and also have a discrimination aspect which here in maine once claim is accepted entitles me to 100 % back pay.I have a lawyer who just keeps saying not to worry because so many dr's are on my side. The company I worked for ( nestle) has a policy to fight all cases, Especialy since there is so many against them. This system is awfull especialy with cost of things the way they are, a person cant survive for 10 months without pay.

RE: court question
Sillyme- ask your lawyer why he has not asked for a ermegency hearing. You should have been recieving checks at least starting one week after the start of your claim, and continue until you reach MMI.

May God send his angels to hold you in his arms
