Hi,
I got injured at work and undergoing treatment for the past couple of months.I am going to work as well which has made the recovery slower. I took a week off in the starting when I got injured,but been ON and OFF after that. I feel like I need to take off for a week or so, so that healing is faster. Not sure how my boss is going to react to that. I don't have a good feeling about that. *Can they Fire me or give -ve comments in my performance appraisal if i did not meet my objectives due to this injury which happened at work? What is the right channel to pursue to take off from work? Should I directly go to my boss and see what happens? or talk to workers comp person assigned for me or to talk to HR / the Supervisor of my boss Please advise. |

I would say your doctor needs to take you out of work. A doctors note should help you depending on your injury and what the doctor thinks.

totally up to the doctor on his take of how you are recovering ... If you just decide to not ho to work then yes boss can write you up for the missed time .. only thing you have are 12 weeks of family medical leave then after that boss can letyou go

Only the doctor can legally remove you from work, without it counting against your attendance record. Your work, and all the employees including your boss, WC, your adjuster cannot argue the fact, if your treating doctor takes you off work. But you will need to get a slip from the MD and supply it to HR (and keep a copy for yourself). This is NOT a fix to the possibility of getting fired....but it helps.
If you have been staying home on your own (without a doctor's slip) this is why they may be getting annoyed with you at work. Since you were hurt at work, and Wc has accepted your claim...if you get fired or not....they still must continue the care & payments to your injury. If you are having pain, and feel you need further rest....call the treating doctor for an appmnt. and talk it over with him. Let him know how much work you have missed since you last saw him. remeber also alot of the states dont pay for the first 3 days you are out so you may be out without pay........do you have any vacation time?
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....
