hearing and settlement

Went by the lawyers office today to find out what was going on as it has been a year since things were sent to commissioner and still no hearing date is set. It has been almost 5 years since injury and checks were stopped in may of 2006. How long is suppost to take to get this mess heard? Also about back payments, From the beginning I was not paid what I was suppost to get,do they pay figuring from time of injury to settlement or only until MMI? Not happy with lawyer but to close to end to change.

Vic, got on your Attorney, for in Ill. they been settleing claims by the numbers. it could be the IC is holding things up. Check with the Attorney if anything is going on, and if any offers have been made yet.

when I asked him he said they were still waiting on the hearing to be set and that if I called it could go againist me and that I would have to just wait it out. It could be a least another year as there was a major back log here in the south part of the state. Also the ic's were dragging there feet and doning all the appeals they could to keep there money.

Rn, I recently finally got the Judges decision on My case, and One of the Biggest Parts of it was that I have been underpaid since Day One. We Won, and the Judge said that I am to be Paid retro. to Day One, with 10% Interest, and they also added a Penalty. That was April 15, and they had 30 Days to catch-up and Pay Me My Back Money, and adjust My Checks coming in now. They Appealed as did We, because We felt the amount I am to be Paid was calculated wrong by the Judge, and the i/c Appealed the whole Decision, which was 51 Pages Long!! Needed to Say, they asked for Superceadus, and this will slow down My Payment for another 30 Days AFTER AND IF the Appeals Board denies the Motion. There is no way they can Win their Appeal, or get Superceadus, it's just another ploy for them not to Pay when Due. But here in Pa., and Trust Me I Will Do this, if they are ONE DAY Late in Paying Me, I will have the Sheriffs Office at My Employers the Very Next Day, taking an Inventory for Sheriff's Sale!! That should get them Moving, and I would Love nothing more than to be there to See the Embarrassment on their Faces when the Sheriff's Arrive!

Vic, I have to tell you this. My case has been being tried to be settled for years now. I will not make an offer, but my Attorney has been telling them to come forward. Now, I was always told, not to rush it. For it will only be better when the time comes. So, I sit and I've been waiting.

Needless to say, I should have mine settled this summer. Or I do hope so.

Thank you BB for at least putting my mine to rest as I was becoming affraid that I was getting a run around. Just don't trust the lawyer and have talked to a couple more and they would not take the case as they think it will end soon and said that if I changed lawyer now it could take a lot longer as they would have to file more paper work and wait on the commission to will just have to wait it out.
