Palm you were a temp worker in a job you your self said everyone in your crew were laid off 2 days later......You had been out of work for awhile.....Ask for a disc o gram and see if there is more damage.....without a rating I dont understand how they are even offering you a settlement......you yourself said the doc released you back to work....so ask for a rating.....that may be a quick offer to get you off their books.....then again I know alot of people making more than that on a job for years and didnt get anywhere near that kind of money......My husband worked for pepsi made 70 thousand a year and had been working for over 10 years when he got hurt.....4 surgeries later he settled for 60 thousand and he got SSDI first time out total retirement period.so your 50 dont sound so bad...
NO ONE AND I MEAN NO ONE gets rich on WC we are very lucky if we dont lose everything we have worked for for years.......

Palm, Don't think they are going to offer any where what you would have made. The first offer I got after 4 years and multi Doctors was less than I made for a year. I have a 85% perm and will never be able to return to the job I loved and was good at. So realize this is how wc is and the best you can do is go back to school and retrain so you can take care of your family.

You have to be at MMI ( Maximum Medical Improvement). I was told you have to be at least a year after your date of injury. I scheduled mine at 10 months as I was at MMI and knew that what all the doctors said, that I would not get any better.

You need to have a doctor that can do impairment ratings. Here at the hospital I went to for PM there was only two qualified doctors to do it and I just happen to be lucky to have one of the two as my treatment doctor.There is many factors involved and different states use different guideline books. For NH it is the 5th Edition.

Things do not move to fast in this settlement stuff. I got a call from the labor board the other day saying they would only settle for 10% , the rating from the doctor the IC paid to do the IME and because of the big difference in rating, I have to have a hearing now.

I got a letter in the mail today saying that my 10% is pending till my hearing. With no word yet of when it is. I have to gather all my records that I want to bring for the hearing to show where I feel my records can show how the first doctor came up with 32% in order for the judge to look at it and agree or disagree with it.

carpal tunnel recurrence/ neuropathy / RSD.
1/29/07 injury date. Permanent. PIR settlement 8/4/08 10%

Hi,
IMO....they are offering you an attractive amount to intice you to bite !
Think about this...one simple surgery or outpatient procedure could well exceed the 50K amount...THEN, where do you stand ?

that's the same thing i was thinking lilly. everybody is saying 50k is a good amount considering i don't have any major injuries. the only thing is i can't make my 20/hr. my dr said heavy lifting is over with far as my career. none of my injuries require surgery. my thing is if they offering me 50k then they must feel like i can get 100k in court and they just trying to split the risk.

that's my only problem. is the 50k worth not taking the chance of going to court. i asked my lawyer what he thought he said he would have to take a real good look at my case and get back to me. if i knew what my case was worth it would be different. for instance if i could go to court and my max award would be 75k i would take the 50k. by taking the 50k i don't know what i'm not taking the risk of missing??????

What is your injury that is being offered that amount? You just said yourself that it is not a serious injury, then why would you even be close to 50,000 if not serious? This is all so confusing. I still do not know how you are getting a offer when you are not at MMI or had a rating of any sort yet. The ic has no idea from what i see of what your injury may or may not cost in the future. Plus whatever rating you do get they can fight it with a IME by PAYING a doctor to go against your rating. They are VERY good at that.

I have a big medical bill each month, and 32 origional percentage rating and still having treatments but at MMI and I have NEVER been offered any sort of money. I just do not understand what kind of injury that they are so worried about? How long have you had this injury?

i've had my injury 11months. my injuries is L3-4 and L4-5 disc bulging. and posterior annular tear and disc herniation L4-5. i hear everybody keep asking how i'm getting offered this that and the 3rd without ratings and mmi. i'm only going by what the ic asked me and what my lawyer tells me.
