Injured at PT Job
Hi, I am new here and not sure if this topic has been addressed previously, if so I apologize.
I work 2 jobs and broke my arm while at my PT (part time) job. I am currently unable to work both my FT (fulltime) and PT jobs. I am in NE. Is it possible that Workmans Comp could or should cover both my FT and PT wages? Some history, I had a previous injury in Sept 07 at my PT job also which required surgery and 2 weeks off both jobs. I used up ALL of my PTO/Vacation from my FT job for surgery and 1 week recuperation, so have none left to use currently. I work on call at my PT job and work is sporadic and seasonal, workmans comp benefits amounted to pay for 1 shift. I have a Short Term Insurance Policy through my FT job, but they will not cover this nor the previous time away from work since it was an on the job injury at my PT job and a workmans comp issue. I welcome any help or advice, thanks! |

that may be a caselaw issue and not specifically addressed in the rules.

In PA that would be concurrent employment and you would be entitled to wage loss benefits on both the FT and PT jobs. I don't know about your state.

I was in the same position, except that it was my F/T job that I was injured in. I was told that I was not entitled to income replacement, for the time off for recovery of my surgery, for my P/T job. They said that if the 2 jobs had been similar in what I did at them, they would then be responsible for it. I am in Virginia.
