rising ... I am with BB on this one. It's what I've had to do a couple of times. I will call 3 times and that's it. Then I make an appt. to sit face to face. I told my attorney when he handled my husband's case that I expected a call back in a reasonable amount of time. Now most times I get a call back that day or at least within 24 hours. Put your foot down. He works for you. CAP God is never late. In the end it doesn't matter how many years were in your life but how much life was in your years. |

Hello, i'm back from sergury and trying to type left handed.lol like you my lawyer does not seem to respond. I still am being denied wc checks and cant undertand why the lawyer isnt pushing this concidering my tendonitis, cubital tunnel, and carpal tunnel are in both arms. Its in my opinion becouse the longer they draw anything out the more money they get. but if you stay on them like what was said before they dont want to lose you.( your money) lol |

It will be a month in a few days since my IME the IC sent me to. I have sent numerous emails to my adjuster requesting my results and also contacted my wc advocate that called the adjuster twice and both times he said he has not received it yet and will send me a copy as soon as he does, and today I took it upon myself to call the doctors office to see if the IME results have been sent to the IC and all I got was a answering machine asking me to leave info and they will get back to me. So I am just getting the run around and need this info before my appt. with PM on May 7th as they want me to ask my primary care doctor for a referral to a ortho doc and I want to see what this ortho IME doctor had to say first about my injury.
I do not know how much time they have to give me the info, but know I read somewhere that the IME doctor would not get paid for their services if they do not get the info back to the ic in 14 days. What else can I do to get this info, as I feel that the doctors office will not want to get involved. carpal tunnel recurrence/ neuropathy / RSD. 1/29/07 injury date. Permanent. PIR settlement 8/4/08 10% |

Hey Sparkey...keep trying to call the doctors office....you may hit a time when a warm body will actually answer the phone! OR, maybe visit the office and ask to see the report at the desk! I'd be going crazy too if it were me in your shoes!

Iowa, like all states has rules of professional conduct for attorneys. One of which is communication with thier clients. Attached is the portion of CHAPTER 32 - IOWA RULES OF PROFESSIONAL CONDUCT that talks about communication. They are required to respond promptly to a request for information and to keep you informed about what is going on with your case. Sparkey,
I got my IME results quickly. I had to ask my attorney for a copy of them. If you are just getting the assistant, ask the assistant to send you a copy of the IME report. Normally they are glad to help out with that. As far as the IME doctor, they are required to send you the info if you fill out a release of information - again this comes down to HIPAA laws. However, since the IC paid for it, some IME's feel that the info belongs to the IC and not the patient so you may have to let them know that if they don't you will report them to the state for these violations. Since you are represented the adjuster may not send you a copy of the IME report as they are to only have contact with the attorney. |
