yes and in Iowa employers are allowed copies of all doctors reports as well tweety from the doctors that you see pertaining to your work injury - If they are self insured and are using a third party administrator (TPA) then the TPA is suppose to handle any other medical information has the employer has not been given the medical release of information for this information - however once again they could say this falls under the WC laws - that is why it is important that you fill in who is allowed the information - i.e. TPA and not company name.
Iowa is employer directed care - so yes they have a say - again if TPA is involved then normally the TPA handles the care of the claim - remember their involvement is suppose to be to get the employee back to work as quickly as possible. And say the employer money and keep lost time to a minimum. So if care is denied then the only alternative is either working through the attorney with their attorney to get approval for treatment or taking it to court in Des Moines - which can take 6-12 months to get a denied claim in front of the commission. For alternative care - they try to get in front of the commission within 2 months. Again it comes down to your attorney filling the paperwork for the court hearing. Remember hearing other than denied hearing are held at many satalite sites across Iowa so that travel to Des Moines is not manditory and also you have the option for phone hearings as well. The only manditory hearings in Des Moines are for Denied Claims. Settlements have to be approved on all sides - employer and employee - if the court has not ordered an order. Even with an order - either side has the option to appeal the decision - 20 days from the date the commssioner signs the order and then the commssion has 20 days to decide if they will accept the appeal or not. Tweety - if you haven't already - sounds like you really need to get an attorney involved at this time if they are still denying you. You only have 2 yrs from date of accident to file in the courts. |
