thats when you go talk to another attorney about the issues at hand.like retaliatory discharge, injury lawyer who ever.my wc attorney sent me to a employment attorney and he found alot of things employer done wrong in firing me.most of those attorneys can tell you right then and there if theres a suit or not most dont charge for first visit.ur right jayne they can fire you but they have to be very carefull in how they do it most are not carefull and dot think you will go after them.i live in a work at will state and they can fire you for ANYTHING....but there are loop holes just like the comp people have but sometimes they work in ur favor. Hi hurt you have me very interested in this .. .My employer was nice at first then after I started to get treatment for my neck and needed surgery .. then they couldnt allow light duty 2 weeks after surgery was done .. then after 12 weeks I was termed .. I do get request from mangers to do something that would push ny restrictrions and whe I say now I get the "Eye roll". The biggest problem has been how they have reduced my hours to nothing. I am in a commission business, and have been removed from the schedule on prime sales days. Sad thing is I DO love my job. Thank you all for the advice! I do think it is time to go at least speak with an attorney, I was just worried that it was too late. |

Well, it's good news. I spoke to my adjuster's superviosor after he met with her, and he sided with me on the issue. He agreed that she was out of line with her rudeness and threats, and told me outright that she had no right to withhold checks for time already missed. He made her send them out immediately, and spoke to her about her lack of professionalism. If she pulls this power trip stuff again, I am to call him.
I win! ![]() I appreicate all the advice - thanks, guys! |
