Applying for a Job.Work Comp Check out?
Hello Friends,
I just applied for a job today and it was with a big company in OK.When I filled out the app.before the interview there was a separete form to sign and date and it had Workmans compansation claims on the top.Asking if I had ever filed a WC claim in the past and signed it to give them the permissision to do this check.I signed it just because I need a job so bad(been off since Aug.06)Have any of you run across this before?Just wondering what to expect out of it.Thanks Born. |

KEEP US INFORMED ON HOW IT TURNS OUT AS I MAY BE GOING THRUIGH THE SAME THING BEFORE LONG AS MY FMLA WILL BE UP AT THE END OF THE MONTH....GOOD LUCK!!!!!!!!!

yes I have and they will want to know if you are well and able to do the job without further injury
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

With the new job I got three months ago, during my interview, no questions were asked about Workers Comp, prior injuries, etc. and I wasn't given any forms to sign other than for a police background check.  A week later, I was offered the job.  However, during the completion of all my "new employee" paperwork, there were questions on the forms regarding prior injuries and whether I had ever filed a WC claim, etc.  I gave them all the info about my WC claim for bilateral carpal tunnel.  I also gave them a copy of my work restrictions and they have worked with me to stay within my restrictions.

I am wondering if this is legal? Has anyone checked with the labor laws and what about ADA? I do know that you have to be able to do the essentials of any job that you apply for, but asking questions about w/C seems a bit strange to me.

I am not sure whats going on but it must be a new way for appilcations going on now like I had read awhile back.This WC Injury will probley Haunt me for the rest of my working life.Maybe all of you also.ITS NOT RIGHT!Born

There was nothing illegal about the way my interview, job offer and employment paperwork were carried out - so I don't have any complaints.  They didn't ask me WC-related questions until after I was offered the job, took the job and began completing the paperwork process.  As far as asking WC-related questions before they even offer you the job - now that's a different story.  Also, just because someone has a work-related injury - that does not automatically qualify them to fall under the ADA laws.

Hi all.... from what I was told by my state's Office of Vocational Rehab it is against the law to ask, whether written or verbally, whether or not a person has ever filed a WC claim before being offered a job, BUT it is normal and allowed AFTER they have been offered a job. Then if they don't give it to the person it becomes discrimination. I was also told to be honest because if they find out somewhere down the road or if you are ever injured on the new job it will become fraud on your part and they will never pick up a comp claim because you lied.Do we really have a choice in any of this but to be honest? Lying will always catch up with us.

I think in OK - they only check with the OK wc court - they can not check with other WC courts as paper work is not filed with that court.
Here in OK it is all different - any time you go to the doctor - all paperwork is filled directly with the WC court. (From what I seen on my paperwork when I seen doctors here in OK even though my claim was in Iowa.) Now that being said - I agree some of the paperwork here in OK is out of date. Did you also get a copy of the job description as well with your application born? and are you able to do the job? Did you apply for this job on line? CCA by chance? |
