how soon after injury and seeing a doctor should i contact an atty.?i spoke with a lawyer and he told me if wc is paying me that there was no reason to have a lawyer.also my hr officer at work said that employer will pay the other 1/3 of my wages as wc pays 2/3.is this correct ?.

If all is going well, there is no need for an attorney. When you hit a stumbling block and are denied medical treatment etc, then you may want to consider hiring a good WC attorney.

The attorney gave you good advice. There is no need for one and there is nothing they do for you until there is a problem with obtaining medical benefits or temporarary disability payments. Most WC injuries go very smoothly and close without litigation.
Depending on what State you are in, WC pays 2/3's of your weekly salary based on prior year's wage history provided to WC by your HR dept. The other 1/3 paid by your employer is actually your Sick Leave, or other accumulated leave that you may have. If you belong to a union, please refer to your contract for details on Industrial Injuries, or talk to a union representative. Let Go, and Let God...... |
