Obtaining a lawyer
At what point during a workman's comp case do you obtain a lawyer? My father broke his arm bad and it looks like his fingers are never going to have the full range of motion.

He is getting his 2/3 pay and bills handled but if there is a settlement for a long term disability, which we still are not sure of, should he talk to a lawyer now? Or wait longer to see what comes of his recovery?

If they are paying the bills and his comp check and doing everything the doc is asking for ....you may never need a lawyer.....its only if they dont do theses things that a lawyer gets involved....It might help for us to have your state as comp is different each state....good luck and welcome to our forum....

In a Case such as that, it would be Good to speak with w W/c Attorney, to be Sure Your Dad is getting Treated fairly! But as long as they are Paying Now, and Your Dad is still Healing, it May be a Bit too soon! As Jayne has said, You may not need One at all, only Time will Tell! I went a year and a half and was given the suggestion that if I thought that my injury could be fixed and it was unlikly that it would cause problems in the future, I might not need a lawyer. But, if it seemed lke I was going to be out of work for an extended time or that I might have problems later on, to seek a lawyer.

When I heard that I needed back surgery, I took that advice and called a lawyer. The 1st vistit is free and I told her that I was not sure if I needed her help at that point or not, because they had been sending me my checks and paying the Drs. bills. She asked me a few questions and i realized that what they had been sending me was not the correct amount. Also, she asked if I personally had filed the accident with the state. I said that I filed with my employer and I knew that the employer had filed with the state...how would I have ever known that my state has a 2 yr. rule. If both parties do not file with the state, the co. can drop you and the state can not step in to help you. I was also told about being reimbursed for travel etc. That is when I realized that I wanted to cont. with this person, as my lawyer.

Ask yourself if you think there will be permanent damage, if so, you may want to get a lawyer. Also, go to sites, such as the one at the top of this page, and learn your rights and what you as the patient are required to do as well as whay your rights are.

lorie those are three good post by good people.just dont let them take ur dad for granted because if they see a loop hole they sure will use it.if you dont know the laws lok them up or talk to a attorney dont let them get the best of you.hope ur dad heals well with no long lasting issues.if they try to settle on disability now when hes not healed i would no do it.you need to wait and see how everything heals before you can even think about settling anything.good luck
