I am getting very very worried now as my IME is comming up. I know that it is the IC's doctor that they are paying and already feel that they are paying him to say it is a previous injury from my carpal surgery 10 yrs ago which i never claimed was work related. 10 yrs. ago i started using the computer at home for personal use and felt that it was because of that , that i needed surgery. So when the question came to me from my insurance co. in the mail , was it work related etc etc. i wrote no.
Now this wc ic is trying to say that it is maybe that i was never healed after the surgery. Which is false. I worked 10 yrs. after drawing blood with that hand, and only had a few times that it would flare up, i would rest it, and it was fine. When i go for this IME, i know in the back of my head that this doctor is going to try to do the best he can for the ic. I am just going to be honest, but i feel so much already like saying " your going to make a decision because your being paid to say it". This is just so unfair. I am already upset and have not even gone. What are the chances of a doctor being on your side and being paid well to be on the IC side? I just do not get this whole wc system. IT STINKS carpal tunnel recurrence/ neuropathy / RSD. 1/29/07 injury date. Permanent. PIR settlement 8/4/08 10% |

it's an adversarial system. your doctor is on your side and their doctor is on their side.
would you think the system was fair if they were all on your side? if so, you'd have a difficult time convincing your employer to support such a system. |

:)not sure if this will help ease your mind but Ihave just gotten my wc case reopeaned after 5 yrs and had 2 wc ime and they both came back good for me,my lawer was really shocked as he never had 2 wc doctors come back for 1 of his clients, one exame was 2hrs long and was very indepth,the other took 12 min and he only looked at scar,didt ask any ?'s or even look me in the eye, let alone let me say anything and it was "paid visit" in my opinion.and both were for me by wc dr's so i know prayers help.

Thanks for your responses. I certainly don't think that everyone will be on my side. That would be unrealistic. But when a Dr looks at 2 MRI's, a Mylogram, pain management Dr., surgeons and PCP reports that all agree what the problem is and you tell them the pain is not improving I do not think it's fair they tell you GO BACK to your regular job and you will feel better. For one thing I walk 7 miles per night on my shift, I have checked this numerous times with a pedometer, but with the pain in my back, hip and leg I can walk 1/4 mile now and then I get fatigued. My job also consists of a great deal of lifting humans, bending, pushing, pulling, twisting and standing. I would never last a part of the night on my job in a nursing home.

The WC system is usually split into two completely opposing sides, otherwise there would be no need for WC court, or the need for each side to prove its case. It still doesn't make it easy to understand how actual medical tests can either be questioned or disregarded. I can certainly see where the validity of a persons word can be questioned, but medical tests would be very difficult to fake. Thanks again for the replies.

Maybe i am " Struggling" as i did not know i was going to court. So your saying after i get my rating from my IME doctor, and having my rating from the other doctor, i will be going to court??? I have to go to court because the IME Dr. stated I can go back to work and my PCP and surgeon say no. So now their lawyer petioned the court to cut my benefits and my lawyer is petitioning the court to review my medical records and make a decision.

Sparkey, There maybe a court hearing in your future and there may not. You have had an ir done by your dr. and the ic has requested another. If the ic's dr. says the same as your dr. then there should not be a court hearing. If the ic's dr. rating is lower than your dr. rating then there maybe a court hearing to decide what the rating is.
