employer dropped appeal!!
This is my situation.
I fell at work June06 and injured my knee. The doctors told me to be off work and slips were turned in to my employer each time I saw the doctor that I was to be off work due to my injury. I began physical therapy and went 3 times. My employer is self-insured and has appealled the claim 3 times in last year and half. The claim has been allowed by the state all along. Since my employer has been appealling they have not paid any medical bills and I only received wage loss checks 5 times and they they stopped those. I had to discontinue physical therapy because i didnt have 800 week to pay out of pocket. The PT clinic would not let me continue coming to pt unless i signed a paper i would be responsible for the bills (since employer was not paying them) which i did. But could not afford it. An 800 bill has been turned into collections. I gave deposition, have cooperated all along and the assistant attorney general has supported the departments decision of allowing the claim. 2 months ago just 2 days before the official hearing the employer dropped their appeal! Finally about a week ago i received a letter from the employers self insured association that has 2 questions on it for me to answer: 1) Have i recieved any medical care for my injury since last records (last year and half) and 2) Do I need more medical care for my injury. I have had to do what I could at home for last year and half as far as therapy on myself. I went back to work 5 months ago in a different state. My dilemma is how do I answer those 2 questions? My answer to question one is no. I simply want to know if they should be bound to pay me wage loss from the time my claim was first allowed till I went back to work. And should they pay my medical bills i incurred and repair the damage from the one bill sent to collections. I want this to be over but I want what is coming to me. It seems so wrong the employer can appeal an allowed claim for almost 2 years,,,which allows them to NOT pay medical bills or wage loss while they are appealling,,,,then drop the appeal in the final hour when they are going for their hearing in 2 days!!

;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....Smile

They are trying to force you to litigate the claim yourself. Ask for delay and hire an attorney. Otherwise, go for it.
