Termination of Temporary Income Benefits
I live in Texas and I was injured in March, 07 & filed a claim. I was seen by a doctor & receiving treatment. In June, 07, due to needs of my 83 year old parents & continued problems with my injury, I voluntarily left my employment. I was not receiving any benefits because I really had not been absent from work. From June, 07 to Dec, 07, doctor kept me out of work for most of the time. I had been looking for work, but I couldn't work due to my injury. In January, 08, I received my first income benefit. However, by separate notice, my benefits were terminated because I had volunarily left my employment. According to workers comp, that should have no bearing on my temporary income. Does anyone have any specific research or information in this regard. I did try to find employment during the few times that the doctor allowed me to work. But, I couldn't work due to the injury.

I am not sure this will apply to you but I will tell you what I did.
I had an attorney that did nothing not even return my calls or answer my emails so I started to educate myself. I was let go from my employment so I filed for Unemppployment. I was awarded this but since I couldn't work without restrictions I could not collect money. I had a doctors paper saying I could not work. On my states website there was a form to fill out for changes to my claim. I first fired my attorney, I could not submit this paperwork if I had an attorney. Filled out the paper and mailed a copy of the doctors paper, along with an updated one to workers comp and copies of all of these documents to my case manager and the insurance company. 4 weeks later I received a check going all the way back. Good luck The IC saw I had an attorney who ignored me and thought i WAS TO STUPID TO DO ANYTHING. tHEY ALMOST GOT away with not paying me. "Laughter is the tonic, the relief, the surcease for pain" |

To get a specific answere to your question your state would need to be known. Every state has different rules and laws reguarding wc.
8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins. Soilders died for our freedom. |
