if an AMA rating is used it'll go up if the surgery is unsuccessful and down if the functional loss and disability is improved. when strength, atrophy, motion, et. are improved ratings are less.

Are you at MMI? I am just confused how you had a PIR rating and did not mention if you were at MMI or not. It will not end there with the 35% and 25%. You would probably be sheduled from the IC lawyer's to have a IME to try to lower your rating.

I do not mean to sound discouraging, but that is the way they work. They will fight you to the end and try to lower the rating as much as possible. Have you had a IME yet, or did you just have a PIR rating? When was it done, and did they put it through to the adjuster yet? My adjuster i had to call as i was waiting on the check he said for the 19%, but then he turned around and said i needed a IME. Noone has even offered me anything. I find it amusing how people get asked to settle and i wonder why they have not contacted me yet for that. I would not do it anyways, especially without medical open.

I have not even heard anything about MMI, I didn't even know what it was until I got on here. I still have the knee replacement coming up next Fri so there is no way they could put me on MMI till after that. When I started questioning my attorney about it he said they just wanted to settle quickly and that it didn't matter.
If I hadn't been on here so much and knew he was trying to mess with me I would have been in a whole lot of trouble.
