RE: discrimination against an injured worker
Tweety- good point. But it being memorial day weekend and all, all the big people who are the only ones allowed to ban a person from the store are gonna be gone. Also, theres a burger king, kmart, target, walmart, 7-11 and a few dozen other stores in walking distance, so If I cant use theirs, there are plenty of others to use. hmm just think of the media hype on that one. Such and such company doesnt allow innocent 3 yr old child to use restroom, child told to go elsewhere. oooooooo bad for business.

RE: discrimination against an injured worker
Ok TRUCKSTER.........I understand more now. Here was my deal. Injured last May. Did everything by the employers rules. Had to treat with on eof employers Dr.s for 90 days. I agreed. Got alot of crap trying to make an appt. since it was 5 body parts. got pissed immediately and hired an attorney before I could even see a Dr. Did this because it was my 5th comp injury with same employer and just had a gut feeling that all would not go well. I had accumulated 70+ sick days, 5 personal days. Got paid using them until Oct. HR put me on FMLA without my knowledge. I have not been terminated yet and the only reason I know that is because although I am paying for my own benefits since I am on unpaid leave I am not on COBRA. Gave my depo in August. IME, my treating Dr. and another PM Dr. I saw have all given depos saying the injuries are real and consistant with the job I was doing. All including the IC's IME have put me out of work permanently. Their IME lied in his depo and said it happened differently than what I said. my attorney went right up his butt with paperwork I filled out in HIS office. I guess although he's on my side he tried to wiggle out of it. When my boss gave his depo I was able to be there to be called as a rubuttal witness in case he lied. He wasn't even in the building the day I got hurt. He clearly stated that I was a great employee, BUT he was mad at me the day before and that's why he denied the claim. WHAT???? I wonder what the Judge will think of that in light of all the medical evidence and 3 well known Dr.s all in my court. Still waiting for the Judge's decision. I just wanted to explain what they do without you knowing it and how they play with you even when all documentation is on your side. It's all stall tactics on the IC's part. I am the only claim that's been denied for 20 years that i've worked for these people. You can believe if I have a discrimination suit because he denied me because he was mad and put me through this hell I will file charges on him. I feel we all have to do whatever we ahve to do to get things right for US. Best always. Sorry this is so long. CAP
God is never late. In the end it doesn't matter how many years were in your life but how much life was in your years. |

RE: discrimination against an injured worker
Well, I have my leave of absence approval letter in my possession. They didnt lie about that (theres a first) however, my boss said they were mailing out my check with the letter, hmmm no check in the box they use. Yes, they are still sending these letters and forms in the small box, with a couple of packing peanuts. Wonder if theyve ever heard of an envelope? I was supposed to sign for this box, but it was just put in my mailbox. It has a sticker on the front that says confirmation signature required. But I didnt sign for it. Oh well.

RE: discrimination against an injured worker
Hi Prncess,
You have been on the receiving end of a "Royal Jerking Around"! Does the other person that got allowed to work with a broken arm also have a child? If she does not, strike up one more point for you in the discrimination case, as your work is also discriminating against you for having a child! PM me and tell me what Company you work for....and I shall steer clear of them during my job hunting!! Take care, and hang in there. Lilly
Injured worker, & tired of it all! I'm too old for games!! A careless word may kindle strife, a cruel word may wreck a life, a timely word may level stress, and a loving word may heal and bless! |

RE: discrimination against an injured worker
No, she doesnt have any kids. Shes much younger than I am. But she is widowed. Her hubby killed himself as a result of what WC was doing to him. I saved her job for her, when my boss wanted me to fire her. SHe has just started new medications and was oversleeping. I understood, I worked with her until she was able to get her meds adjusted and taken at a certain time so she didnt over sleep. I'm not in anyway upset with her, (though she owes me 35 bucks and is blowing me off because of it). Poor kid has been thru a lot in her young age. But its just not fair at all. One of 2 things will come out of this, she will be able to work, and they will have to let me come back or, they will take her off work, like they are doing to me.
