yeh cap,tell me about it!! i'm pretty sure that hr knows whats going on as they are the ones who told me i had to take fmla...when i went up to work to find out if i was still employed there or not,no one could tell me and still have not told me,so i am still in limbo....sorry limbo, i stole it for a minute......not knowing if i have a job or not,and of coarse no one will put anything in writing.the difference between us is that it sounds like you were on salary and i get payed by the hour and comm.,so no work..no pay!!!!! so i'll collect ttd for awhile until i go back to i/c doctor later this month and let him know that they would not accept me back!!!!

Hi all...you no to me this doesn't make sense at all. An employer's bottom line is much better if they encourage light duty for IW's. Usually a company will not provide light duty for someone who was not hurt on the job unless they are being nice. But then again they may want to be nice and they can't because the labor board will make them do it in every instance. That would absolutely hurt the bottom line. This especially applys if the company has an union. I can only say that your bosses are not the bottom line people and they do not understand the financial picture of the company to not accept an IW with restrictions from their doctor on light duty. They probably do not participate in the building of the Workers Compensation contract and probably have never read it. They do not ask about the quarterly payments or watch how they grow with IW's. They can't know this a make these sort of decisions. Who is there boss? They have to have a boss out there somewhere who knows more than they do. I am just amazed that this type of thing would go on, not because we should all take care of each other, but because they are not taking care of their company if they are not bringing their IW back to work when released.

As of now, its the company's HR deptartment that is saying I cant work. My boss has said it before that he doesnt want me back until im 100%. He doesnt have the last say in it, HR does. The same guy who lied and said he never received my updated dr's notes is the one saying I cant return to work yet.

I AGREE WITH YOU RED BUT IT SOUNDS LIKE BOTH MINE AND BNP CASES ARE ABOUT THE SAME IN RESPECT TO BEING W/C...IN MY CASE I RETURNED TO WORK AFTER BEING OUT ON TTD FOR 6 MONTHS ON LIGHT DUTY RESTRICTIONS,BOSS SAID THAT THEY DID NOT OFFER LIGHT DUTY AT FIRST AND AFTER THE FIRST 6 MONTHS I WAS RELEASED TO MODIFIED DUTY WITH RESTRICTIONS AND BOSS ALLOWED ME TO RETURN, WORKED FOR 6 MONTHS IN ALOT OF PAIN,BUT WORKED. RETURNED TO I/C DOCTOR,HE GAVE ME SOME MEDS AND SENT ME BACK TO WORK WITH SAME RESTRICTIONS, BUT ON MY RETURN THE NEXT DAY, I WAS NOT ALLOWED TO WORK AND HAVE NOT WORKED SINCE...DON'T EVEN KNOW IF I STILL HAVE A JOB!!!!

BTW I SAW BAD BOYS RESPONSE THAT SAID YOU HAD 6 MONTHS TO FILE DISCRIMINATION CHARGES???? NOT IN GEORGIA, 180 DAYS FROM THE INCIDENT BEST I CAN TELL!!!!
