what determains a cash settlement
OK I keep reading about cash settlements, hows that work. Again I am in Idaho dislocated my ankle broke my tibula and broke my fibulia in 6 + places and now have a metal plate and six pins in my right leg. Here in Idaho we have the Idaho Industrial Commission and I had a visit with them today. They say my employer is wanting me to come back when I can and the the I/C is taking care of bussiness like they should and they see everything going well. I also went to my doc. today they removed my cast 5 weeks since my injury and took xrays everything is healing great they say. My foot is discolored and has lots of pain they say that is normal and should expect it to be swollen for 4-5 months. I have been put into a aircast/walking boot. In the next week I am told I will be able to put up to 50% weight on foot and in three weeks should be able to put full weight for limited time periods. Will I expect to see some sort of cash settlement or is my injury to mild per w/c. I looks like I might go back to work in a light duty manor in 4 1/2 weeks I know I will be limited for sometime before I can take part in my normal activities like flyfishing the river shores, hiking the foothills with my lab. and all the other cool outdoor stuff I like to do. Does this make a differance. I don't know where to find this out. Thanks Doug

wc could care less about anything outside of your job and does not pay pain and suffering......if you go back with no disabilty there most likley be little or no cash settlement.....

I know patience is difficult....but you must let the healing senerio play out, to determine what the max medical improvement (MMI) pans out to be. Then you can worry about what comes next. Our boobless, but dancing green Jayne is so correct...IC can care less about your loss of function, pain level, or difficulties in your daily "play activities" and whether you can ever partake in them again. Their main goal is to get yer behind back to work asap! This means even if you are still in pain or not functioning at 100%. I know it's so hard to wait and to plan ahead, but you are stuck in the situation, and must see how it turns out. remember, if and when you are released to return to work....you need to follow to a "TEE" the doctors restrictions, even if your employer puts you in situations that go beyond the bounds of those restrictions. You have to stick to yer guns!

I AGREE WITH THE GREEN DANCING MACHINE.AFTER YOU REACHED MMI THEN YOU NEED TO RE-EVALUATE YOUR INJURY AND FUTURE MEDICAL.TALK TO YOU DOCTOR ABOUT WHAT KIND OF PROBLEMS YOU MAY ENCOUNTER IN THE FUTURE.WC IS BEING NICE RIGHT NOW BUT TRUST ME THEY WILL TURN ON YOU.IF YOU FEEL LIKE YOU NEED TO GET LEGAL ADVICE THEN SHOP AROUND.GET A GOOD LAWYER WHO IS NOT LOOKING TO GET A QUICK HUSSLE AND IS IN IT FOR YOUR INTEREST.MAKE SURE THEY HAVE EXPERIENCE IN MEDIATION ALSO. I Agree with all of the Above also. The determination of if a Settlement is going to be Talked about at all is how Well You Heal, and if You have any Permanent Work Restrictions. As far as what You can or cannot do Outside of Work has nothing to do with a Settlement, they only Care about Your ability to Work, Period. And Pain and Suffering do not come into Play Either. I am Totally Disabled at 45, it's been 3 1/2 Years, and they haven't even Mentioned the Word Settlement to Me Yet! As I Posted to You before, Patience and the Knowledge You are Learning here, and other Places that You May find it is All that You can do right now! It's too Early in Your Recovery to Answer Your Question! Best of Luck!!Smile

when you have reached maximum medical improvement the doctor will determine if there are any permanent residules.
The doctor will provide the work commission a whole person impairment rating and additional permanent disabillity will be based on the rating. The higher the rating the longer the weekly benefits will be paid.
