wageloss in north carolina
ive been on ttd for over a year now and no luck in finding suitable employment.my question:if i was making 22 dollars an hour and vr finds me a job or just sticks me somewhere for 6 dollars an hour.does the wageloss apply for life?they want to settle at mediation and have offered to send me back to school but even with a four year degree in this area i want make close to what i was making.i know in nc you have a choice to settle for rating or wageloss.i really dont want to settle but i cant survive on a lesser paying job.

you can do alot of things you think you cant......we dont need alot of the things we have.. we want them...during my ride I found out I could and did have to live with alot less.....I dont know the rules in your state someone will come along that does but most states have a cap on how long they can/will pay you.....inform yourself as best you can....

thnx for the reply.thats the main reason im leaving medical open because i know i will never make the same money and will need knee surgery in the future.i want take a lump sum unless it is worth it.if i am lucky enough to get wage loss for a life time i will never settle because where i live even with a degree the pay is not good.my wife has a four yr dgree and only makes 13 dollars an hour.my lawyer told me awhile back that in nc you could settle on wageloss or rating .to give you a brief back ground.wc has offered to pay my way through college because they know that vr will probably send me there.they told my lawyer to get numbers together and he did.we asked for 4 yrs college and 5 yrs of pay(2/3 of my reg pay).they then in turn asked for a settlement mediation(informal and voluntary)there attorney told my attorney that it would be in there best intrest to settle the case.i go to mediation in a month.do you feel like they will throw me a curveball or you think they probably want to talk the settlement down?i also have alot of restriction(FCE)and mmi doctor added no squating.this is making it very difficult for someone to hire me.if they want to pay 4 school they need to come on because im already 38.i also agree with what you said about ajusting your lifestyle.i have took a pay cut being on wc and have ajusted well.thnx for the time to reply

I have never heard of a state paying for 4 years collage so I dont know what to tell you voc rehab yes but collage no....most states have a 5 year cap total so all I can say is go get em but I am having a hard time thinking NC has all this good stuff going for the IW most states just give us the screw... GL

took a min to read up on NC and the law says they only pay wage loss for a total of 300 weeks and you have collected over 52 of those weeks now? and out of that money your lawyer will have to be paid.....who told you collage? what is your injury and what is your rating? Have you had a set down with your lawyer and he told you this? voc rehab is usually a trade school or some chitty thing they can get you in and out of fast......

i just talked to my lawyers secretary and she said it was 300 wks.she told me that they have to retrain me for "suitable Employment" or i have to find "suitable employment" on my on.she told me suitable employent is close to what i was making.if i went to a hearing and a judge said that 6 dollars was suitable then i would be able to settle on the wage loss of 16 dollars times 2/3 for my remaining 300 weeks.she said the lawyer will fight the "suitable employment".suitable employment to me and my lawyer is around 16 dollars but you know how judges are.wonder how that judge would feel if he had to go down to mininum wage.bet that wouldnt be suitable to him.lolol.she also told me that the knee surgery i will need in the future comes in to factor also because i will miss work when i have the surgery and probably a new FCE and Physical therapy.i have broken cartiledge under my knee cap and can work at a medium to light level.also no squatting.ive been told by 2 ortho surgeons that i need to put it off as long as i can but i would definitly need it.secretary told me also that wc wants to settle because of the futur medical im going to need.i will gladly settle out the 80000 or 90000 dollars of a mininum wage job but i want to leave medical open.
