I think I need to get a new attorney? I no longer fill that I can trust mine. He soesn't explain things to me he just tells me that the settlement amount is what it is and that if I want to fight and go to court then I'm on my own. He refused to give me copies of my file ( told me he didn't legally have to). He told me that workers comp didn't have to pay me after I became P&S and said that I should go get a job, file for edd or sdi until I could get back to work. Now the sdi shows up at the settlement hearing and they want all of my settlement because they say that I should have been getting permenant disabilty payments from workers comp. I hired the attorney so I would be properly advised to make the right decisions. I've never been injured at work before so I am confused
Does anyone know of a good honest lawyer in the San Diego area. This is just a small part of my problems. Thanks for any help. |

RE: attorney problems
1171 Wrote:http://www.workinjury.com/classifieds/app.htm#sd Thank you very much but how do I know which attorney's are honest and will fight and not just want to settle. I feel like my injury isn't worth that much so my attorney doesn't want to bother with it anymore. I think he wants me to go away so that he can work on bigger cases. I saw a attorney that was very friendly and she said she would take my case if I wanted her to but how so I know if she's any good at lawyering. She looks very young how so you find out how much experiance a attorney has? She is great at explaining things though. I've read a lot of your replies. Sounds like you know quite a lot about this process. Thanks for your help 1171 |

RE: attorney problems
![]() trust is subjective and is different for each of us. you can't look into the future and know ahead of time that someone will betray the trust (unless, of course, you're the "Medium") There is no universal rating system for doctors or lawyers or 99% of the services we need and use. Interview a few lawyers. pick the best you can. and be prepared to change when you need to. ![]() This may help (be careful -- it was written by lawyers....!) http://research.lawyers.com/Selecting-A-Lawyer.html --you don't even know if you can trust all the messages here -- that's why I always try to post the links so you can check for yourself.... ![]() P.S. if you learn as much as you can you'll make it more difficult for them to take advantage of you. there is a lot of information on the web especially for those in california http://www.dir.ca.gov/dwc/iwguides.html there is even a book you can buy (written by an atty --) that can help http://www.amazon.com/California-Workers...65&sr=1-15 and some more articles on different topics http://hurtworker.com/english/articles.htm being a knowledgable consumer is your best protection.... |

I wish I had found this site two years ago when I was first inhured it could have saved me alot of stree and money. I will check out the web sites you gave thanks for all your help. I feel a lot better being able to talk to people with the same sort of problems. I have felt so alone dealing with this and not knowing anything about the process.
Thanks |

RE: attorney problems
Tink even if the female attorney is young if she explains things and you have a good rapport with her you may want to give her a try. She may work extra hard for you since she is just starting out because she will want to build a good practice. Remember if she is a new lawyer she hasn't had time to forget anything she has been taught yet.

RE: attorney problems
Your right about her but I'm just afraid of making the wrong choice again. Thanks for the advice and that law firm was recommended by my union so there is a good chance that it does good work.
I wish there was a way to tell other injured people about this site maybe they wouldn't feel so alone and confused either. I can't tell you how good it feels to be able to talk to other people going through this thing. Thanks again to everyone who has replied. |

RE: attorney problems
I read a few other threads before I figured out how to post one of my own. Why would other people say they don't trust this site. Are we not allowed to talk to others about what we are going through. Is there some workers comp rule about this that I should know.

RE: attorney problems
Who told you they didn't trust the site? If it is the IC they probably don't want you to educate yourself about your rights. I know prior to my injury I thought this, you get hurt and the WC IC does everything in its power to get you better so you can get back to work....Wrong.. They let you sit and try to get you back to work even when it is not possible for you to do your job. I always thought insurance was paid so if you are hurt you can get treatment. If they would have done what I wanted in the beginning I would have had my surgery by now and been back to work. Now I just sit here like last night not getting any sleep because the pain is so bad. What I think is worse is the fact that they put you under so much stress while you are already injured, which makes everything so overwhelming that you can't take any more and you just give up.
