Applying for jobs after MMI
Hi everybody, its been about a month since I posted last and still can't get the wife to join in oh well. My guestion is, my wife got a letter from the guy thats supposed to help her find employment with her restrictions and he says go apply here and there. (This is the first time he has sent one of these) Problem the jobs he said to apply to are 40 miles to the north and 40 miles south. I wouldn't let her drive that far for work even if they payed 25.00 an hour but they are at the most 10.00 an hour. That won't be worth the wear and tear and gas let alone the aggrevation with the fools on our roads. It comes down to does she have to do this I don't know if this is something her lawyer is pushing because the lawyer said to send the apps to him(got a letter from him the same day) so they can fill in the restrictions. She is due to do a deposition in March and in the same letter from her lawyer it had a bunch of mumbo jumbo about court dates. She is calling the lawyer today(120 miles away)just want some ideas. We are in Florida if that helps,the depression has subsided but now all the confusion starts up again. Thanks again

depends did she travel that far before?going for the interview doesnt mean getting the job.....if she refuses to go they will say shes not trying and stop then your in non complinace
;)Workmans comp is not a road you want to travel alone.You need a good lawyer,a great family and good friends to lean on.If you make it thru without losing everything you have worked for all your life,you have come out ahead of the game.....

Hi Jayne, No we purchased our house in a nice area so we did not have far to go to our jobs. ( 2 miles at the most for her for 14 yrs.) She made somewhere around 15.00 an hour I don't think it's right people are killed on our stretch of I-75 daily because of fools and I won't subject her to that.

Hi Roadrunner, Did a quick search of Fl statutes, didn`t see anything about mileage, but remember seeing something somewhere though. Over 50 miles rings a bell (figures). WC can screw with you if don`t go, Jaynes right there and who knows if she`ll get the job. You`ve got to play the game though. I don`t blame you about the drive, I live in SWFLA and did the I-75 death run for years. Good luck CJ.

Just a thought, if she does find that she needs to go for the interview, (and you have probably already thought of this) but if you can drive her to the interview and hope (and pray) that she doesn't get the job. Just a thought.

Hi.
WC can force you to drive within a 50 miles radius from your home. The same thing happened to me while I was in Voc Rehab. If the VR person sends your wife jobs to apply for....she must comply and respond to them. This does not mean that she'll even get an interview though. I tried to mail my resumes as often as possible. She must play the game and go through the motions, and search to try to find a job no matter if it's 10 miles or 50 miles away. I'm in Mich...and WC had to pay my mileage to & from any interviews, my stamps from sending out resumes, they had to supply me with the printed resumes, pay for long distance tele calls etc when i was job hunting during VR. Remember, if the possible place of employment is a long drive, she can always have a 'not-so-good' interview. I lucked out, as My VR person took into consideration the mileage driving distance and the actual pay rate and would tell me it wasn't worth the trip to work there anyway....but i had to try and put forth the effort. In actuallity, my lawyer advised me NOT to get hired anywhere. The VR part was very stressful and very long. I wish her luck in finding a job she can do, within her restrictions, & close to home. I'm no longer in VR, but I'm still searching for a job that could suit me and honor my restrictions....and one that can put up with a new employee that can't be 100% reliable. My case was in Nebraska. Much the same applied while I was in Voc Rehab. Like Lilly, I was fortunate enough to have a voc counselor that was sensitive to my vehicle, the rate of pay and the miles to/from should I be hired. That helps alot!! However, there will always be that arse out there that will NOT think of anyone other than what the law says or what they believe it to be.
Yes, you need to comply, or you'll be considered non-compliant. HOWEVER, I would do this: The person that is telling you to apply for jobs to far away should be asked to help you get there should there be an interview!! If for some "reason" the vehicle was acting up and/or you had nobody to help you get there then....well, I suppose that's circumstance out of your control!! LOL I'm sorry, I usually don't advocate being dishonest or sneaky, but sometimes people are just so not smart and don't think any further than their noses that it creeps into the "how can I get around this without getting into trouble" category!! Know what I mean? LOL Good luck.....I'm sure it'll all work itself out sooner or later!! Do ask your attorney what is what and see if he/she has any advice for you on this!!! Hi everybody, thanks for the great input I knew I could count on you. My wife has a coference call with her attorney today and I should know more tomorrow. I will help her comply but I figure by the time she gets the app. back from her attorney the job will be filled she is doing what she is told. Everybody have a nice day we have to brace for 40 degree temps tomorrow a.m. LOL not trying to be mean to the northern folks on here but thats a little nippy here. Thanks again
