Texas WC question
In the state of Texas medical coverage for the injury is for life. With that being said, My damaged body part is the L5-S1 Disk with nerve damage. I have been told by several dr.s that the disk above (L4-L5) will probably need surgical intervention in ten years because it is now compensating for the fusion of the L5-S1.

Should that happen. Who is responsible???????? me (other insurance) or WC??????

8-05, Micro laminectomy/disectomy. 10-05 lumbar fusion L5-S1. 2-07 exploritory surgery. 12-07 medical implant, Spinal Cord Stimulator. now receiving SSDI. Jesus died for our sins. Soilders died for our freedom.

there is no pre-judgement used.
a medical determination at the time will have to be made. If the causative agent is still the 10 yr old work injury then the old claim is liable. if there have been intervening events and factors then those could be held responsible and the prior comp claim is off the hook.
