i've been injured since 6/07 and i've had restrictions since 9/07 and my job hasn't honored them yet. i got an inside source that says my job has no intentions on bringing me back to work,but they haven't fired me. i was wondering would it be a bad/good move to tell my lawyer that i'm tired of sitting home everyday and i'm ready to get this over with. i want to settle everything including medical. they've already cut my checks based on an ime they sent me to 1/08. so now i have no income and they want give me a job with my restrictions. i didn't work long enough to draw unemployment and i'm not in the union at work so i have no job security. i go to court on 2/27 for dispute of unpaid medical bills and period and extent of disability. i told my lawyer they stopped my checks and he told me to get my latest medical report with my restrictions and bring it to court. i go to the doctor tomorrow. i'm tired of not being in control of my life and i'm ready to get this over with. i've heard a lot of people say not to settle medical but i don't want anything to do with wc and since i don't have a job to go back to i figure whats the sense of dragging this out. honestly what do i have to gain by this going on and on. i feel like if i settle now or settle next year the outcome gonna be the same. if anybody can shed some light or give me some advice it would really be appreciated.

Personally it is not that simple to just " get it over". Why can't you just find another job within your restrictions and have medical insurance with your new job along with the wc insurance for the injury you have now? What kind of injury do you have? Has the doctor put you at MMI yet? What was your rating by the IME doctor? Sorry for so many questions, but depending on what your injury is, you may need to have surgery or something done down the road that you would not have money to pay for it.

I have a injury that happened 6 months before yours with Carpal tunnel recurrance, and had my PI rating done where the doctor put it to high that now the IC is having their lawyer set up a IME doctor for me to see. I just do not think it is as simple as you think it is, and if the IME doctor put it very low, and you have a lawyer, you are personally going to walk away with nothing after paying him and also have no medical at the same time. Just my opinion that getting out of WC is not just a easy fix. Sorry for all the questions above, but they may help others answer the questions also that you are asking. Someone will be along maybe with a better solution. Nothing says you have to stay with the employer you have now.

get another job within your restrictions then you'll be in a position to wait.

you are absolutely correct: not working and waiting on them to do something puts them in charge and gives them all the advantages.

i have herniations disc bulging protusions and annular tears. i'm not sure if the ime had some kind of rating system he just basically said there is nothing wrong with me and i shouldn't have restrictions and his personal opinion is i want willingly return to work. before i got hurt i was making 18.44hr plus 2.10 cola thats 688wk after taxes. then i started getting 400wk and once i got my restrictions(9/07) it dropped to 360wk and after the ime(1/08) it dropped to 0. my court is next week and i don't know whats gonna happen. what has me baffled is why my job hasn't 86 me yet. i'm non union so i have no job security. wc isn't preventing them from firing me so whats the catch. i was only working a month before injury so its not like i'm a major asset to them. that makes me think i got the ups on them about something i just don't know what. theres no way i can get a job paying anywhere near 20hr with no experience, no diploma, and with my restrictions. plus since job cut my checks they wouldn't have to pay a wage difference anyway right. so you can see why i'm ready to get this over with.

once again let it ride because i got hurt at work and did everything by the book and got took after 11 yrs.did my job then some got hurt had to have surgery.was good friends with my bigggg manager and the vice president guess what still got fired because the dr would not release me.still fighting today and facing another surgery and my injury was in 05.so dont sign off......... if you do thats what they want.its ur life but dont do it,talk to ur att tell him all your thoughts and be very clear about them,let him know how you feel.
