Time line to claim/file
My wife and i live/work in Texas.

She works at the local school district in our town on a part time basises. What i am trying to find out is how long does she have to file a claim from the approximate date of the incident?

The Story:
Around 2oish Nov 07, she lifted something in the cafateria. Initally she thought it was a pulled muscle in the elbow area. she did mention the incident to the assistant manager and the following day to the manager. of course, they do not remember the conversation. Also, they did not inform her how to do anything with workmans comp.
after a month of listening to the pain, i finally told her to go to the doctors office. they looked at it and gave some pain medication. after the first amount run out, the doctor recommended going to a specialist. the specialist admin person asked if this was a workman comp item. my wife did not know what that was. she interputed that as being did this happen at work. She said yes. the specialist admin stated we would have to pay ourselves or get a number from the school. In Jan 08 my wife talked with the school about the incident.
as of 4 feb 08, they stated they would not be covering the incident. Then, 5 feb 08, my wife gets a call from someone in the school district asking information and stating the decision has not made about the workmans comp.
I am hoping the claim time is over a few months. specially since the Thanksgiving and Christmas breaks.

thanks in advance for any assistance,

RE: Time line to claim/file
"You must tell your employer within 30 days of the date you were injured or first knew your injury or illness might be work related."
http://www.tdi.state.tx.us/wc/employee/w...ights.html

that doesn't necessarily mean the claim is automatically rejected.
to get more information about the texas comp laws see their website

RE: Time line to claim/file
I also worked for a school and was injured while working in a classroom. The person I reported my accident to said they didn't remember me reporting it but when HR checked the school log book they found my accident had been recorded.

Does your wife know the date and time she reported the accident to along with the name of the person she reported it to?
