Can Defense Use This? -- 1171

Hi 1171,

If a C/A is sent documents the I/W wants to provide a PQME, electronically, and the C/A then rejects the documents, can Defense then use those documents as discovery after the I/W's deposition?

If I/W doesn't provide those documents for deposition and states they have been given to attorney and are now considered confidential between I/W and attorney, would it be then illegal to use them as discovery?

I don't think either party can withold relevant information concerning an issue before the court.
Of course, either party can request a ruling from the judge on admissibility of evidence.

My AA's ass't told me to PLEASE let them do the worrying. It's just so hard thinking of all the what if's, especially since I handled my claim pro per for so long. I have an AME and a Depo coming up and am a little unnerved not knowing what to expect.
